So is a Tier 1 General not a highly skilled migrant? According to the below link it is. In which case paragraph 245AAA(c) would be relevant.

I reckon the reason for this change is to address current Tier 1 General ILR applicants, who were previously on one of the lower categories (eg. tier 2, WP, etc) in the earlier part of their 5 year qualifying period........I dont believe they expect such evidence for applicants whose 5 years qualify...

Wildjoe - my case is a little different in that my total absences over the entire 5 years is 172 (but similar to your case in other respects). I have been given positive advice overall from various agencies regarding my unpaid holiday leave situation.

where does it state that same day application at PEO is ONLY for complicated cases? If you pay the premium, you get to apply in person at PEO....simple as that isnt it? my understanding is that it can still be reviewed further even at PEO same day applications... phone a few more consultancies for s...

congrats! i am in a very similar situation to you, on HSMP/T1, i am applying in mid May though.... i have 172 absences in total over the 5 years, no absences over 3 months - (possibly now irrelevant) , biggest ambiguity, one unpaid absence of 63 days (travel/holiday)....so fingers crossed.........fr...

still awaiting a reply, been working closely with my immigration consultants, my situation should be fine so not worried..... its all about the 180 day/90 day rule in 5 years! if you are within this, I believe you will be fine
