Re: Immigration advice please urgently

I am aware of successful applications through both routes after overstaying.
The spouse visa is probably the better and quicker route in general terms.

Re: More than 180 days outside UK

Your employer must terminate your UK skilled visa as you are no longer working in the UK. Failure to do so will potentially end in the revocation of their sponsorship license. So there is no option but to give up your visa and reapply on your return. Doing anything else will land your employer and y...

Re: Skilled worker Cos dates and IHS charges

Your employer can issue a COS with a start date of 2nd September 2024 - and that saves all the hassle. This assumes you will be extending with the same employer? The COS can be issued up to 90 days before the start date and you can apply up until the 2nd September 2024. A lot of over thinking to sol...

Re: Graduate to Skill Worker Visa COS Issued Before 4 April (New Entrant) Total Sposnsorship Time Allowed

The salary being offered is above the new enterant level and met the previous minimum salary threshold under skilled worker route. As long as it met or was above the rate for the job for the SOC prior to 4th April it will be processed as if a standard skilled worker visa.

It means what it says, expect the visa HOWEVER until the official letter is received it is just keep the fingers crossed. It is never finished until he has the letter.

Re: safeguard and support email from HO

DO NOT REPLY TO THE EMAIL - this is not a normal e-mail and the Home Office does not routinely contact Doctors. Not their role and they would need your formal consent to contact the Doctor

You have at least two routes:
Spouse visa or Private Life.
Private Life would probably be a better option given your immigration history

It is not really about your ability to sponsor the individuals. It is about their circumstances and how the Home Office views their ties to their home country.

Can’t be done, only the Home Office can do that and they do not do offer a verification check.
Do you have some concern about your COS?

Re: TIER 2 VISA TIMELINE AFTER HOME OFFICE INTERVIEW

MP with all due respect will be sent a standard letter basically saying “thank you for your query and the case is ongoing”
It will not speed up your case.
Where the other two visas for different roles?

Re: TIER 2 VISA TIMELINE AFTER HOME OFFICE INTERVIEW

Are you in the U.K. under a visa that lets you work? Guessing graduate visa? Is the role you were performing in the care sector- if so then I suggest you check the sponsor register to see if the sponsor is still listed. Otherwise it is just a case of waiting, I suspect there is or was an issue with ...

Just checking- you got married in 2011
If that is the case you can go down the EU route, but that will reset your ILR clock

Re: Asylum refused

The Home Office does not care that if you get married or not. They can intervene if they don’t want you to marry, if they don’t you are part way there to proving private life if you don’t go for spouse visa

Re: SW to dependent of EU Scheme Pre Settlement

If your relationship with your EU family member had started by 31 December 2020 then you can apply as their dependent. Given your wife did not gain her own pre settlement until after that date that would suggest you do not qualify. When did you first meet? Did you live together before marriage? What...

Maternity leave is treated as being in employment and does not impact your ILR.

The Home Office can’t remove you unless they serve you notice of removal. Your refusal letter might have the notice within the wording.
How long have you been with your partner at the same address?

Re: Asylum refused

I am surprised it took the Home Office so long to refuse your asylum claim. I have heard of US citizens claiming asylum but thought it was an urban myth. Appeal by all means but that is not going to overturn the refusal. The US is a safe country that is governed under the rule of a law as a fully de...

Re: DCOS assign to brother

I have seen many close family members gain skilled worker visa. Stick absolutely to the rules, declare it on the SMS / COS note field and there is less of an issue. The biggest problem is non declaration and the non-genuine vacancy scepticism. The OP has followed the rules, the job looks very like i...
