Do you mean any other documents related to the accomodation?
You need to show that the flat won't be 'overcrowded' once your wife joins you...how many and what size are the rooms. You should also have a letter from the landlord stating that your wife can live in the shared accomodation with you.

The other little anomaly with the test...if you were from another EU state living in the UK, and your spouse was Thai...they wouldn't need to pass the test for permanent residence. Only if they wanted to apply for BC.

Your level of income could be a problem, as your employer is presumably employing you illegally, paying 'cash in hand' with no payslips...which will mean that you won't be able to show these earnings on your wife's visa application. Do you have children? If so the Chikwamba ruling may be an option t...

If you check the ESOL requirements for ILR, this also states that you must progress from one level to the next. As you have said...your friend recently submitted ESOL level 1 for BC. It is irrelevant whether the language requirement was required previously for ILR. BC applications have the same requ...

If it was accepted for ILR (the same requirements for ESOL), that will be sufficient for BC application. i.e definately doesn't need to be taken again.

It's always safer to apply by post if you don't have an absolutely straightforward application. A PEO is there simply to check that all the required documents are there, and they don't have the authority to deal with any applications that need further consideration or explanations. Apply by post, se...

If you already have ILR and have the ESOL certificate, nothing more is required for Nationality. That's it as far as the English test goes. :)

Your legal status in the UK remains as per your current visa while your application is being considered, irrespective of how long this takes.

Might be a good idea Saloman, just in case. It would give you time to get your visa application in good time before the new regulations are in place.

Lloyds TSB opened a bank account for my non-EU husband without a National Inurance number when he first arrived in the UK. When we opened our joint account later on with Nat West they didn't request a
NI number from either of us.

And what will happen if someone fails to notify the HO of the intention to marry before they leave the UK, and the spouse visa is then refused under this rule. Will there be no way to rectify this? Excluded forever?? :(

I can see another problem arising from this new legislation. If anyone intends to marry overseas they must notify the HO of this intention before leaving the UK, otherwise a Spouse settlement visa will be refused. Where will couples stand if they are unaware of the ruling before they marry. Not ever...

This code is the correct entry for an unmarried partner entry giving the right to ILR once KOL has been obtained. I've double checked it for you on the UKBA website. :)

Absolutely. Depends I suppose on how confident they feel that the test will be passed easily and at first attempt...unless they can stay on until they're successful.
Good news though that they qualify for the visa under living 'akin to a marriage. :)

The visa will read ILE(KOL req)... which will give 2 years to enter and to satisfy the KOL requirement. This visa will then be amended to ILR when the application is submitted. Without the application and amendment to ILR the visa will expire in 2 years from the date of issue of the original entry v...

There are a couple of important points here. Firstly I believe that ILE (Indefinate Leave to Enter) is only available to couples who have been married for a minimum of 4 years. i.e not living together in a relationship akin to marriage (a 'common law' marriage). If however you do qualify, you would ...

If you return before the 1st October when the new legislation for overstayers come into force, you won't be subject to the automatic 1 year ban (or 10 years for extreme cases).
