Re: ILR my non-EEA family member

in order to be ordinarily resident the child has to be lawfully resident. if he is over 21 this means he needs to be dependent. the guidance is based on the student support regulations. these are the regulations that sfe use when considering an application for funding. I am not aware of a successful...

Re: ILR my non-EEA family member

If he resided in the UK as a family member of a migrant worker, then he has an independent right to Student loan, even if he is not still dependent on you, as he installed himself in the UK at a time when his father was a migrant worker. Obie can you say which part of the funding regs you are refer...

Re: IHS fee for children - online application issue

you didn't need to pay before because your daughter was applying for a visa for less than 6 months but that also means she is not entitled to free healthcare during the period and would be liable to pay overseas visitors fees healthcare .

Re: Any kind souls please help - UK Tier 4 Extension

the other thread is about interviews from outside of the UK. all tier 4 applicants who apply from outside the UK are interviewed so a second interview is more significant. a first interview for an in country application is basically akin to a second interview for an entry clearance application. they...

Re: Can I apply for a Tier 4 if I'm with Work&Holiday in Aus

country of residence does not mean permanent residence. you can apply in Australia if you are lawfully resident there (I.e
generally with anything other than a visit visa)

how long have you and your partner been living together?

Re: AT what stage to switch from T2 dependant to T4

She can't switch in the UK. she may not have enough time to go home over the Xmas vacation to apply for her visa. she needs to speak to her university to explain that she won't be extending her Tier 2 dependent visa beyond jan 2017 and ask if they will be able to sponsor her under tier 4

In order to understand the reason for visa rejection I wanted to know his situation/location at the time of Visa application Also since Visa rules don't allow to change from Tier 2 ICT dependent to Tier 4 within country visa rules do allow him to switch in country. he is not switching to tier 4 he ...

I understood your query. I asked whether the reason you have quoted is the only reason or whether this is just part of the passage you have quoted. that's why I suggested that you post the whole text of refusal (of course taking out personal details.) if that is the only reason they have refused and...

Re: Tier 4 -> PSW -> Tier 4 -> Tier 2

The PSW visa in between the Tier 4's effectively stops you from using the first masters time on Tier 4. I don't think this is correct. there rules allow the migrant to rely on a previous degree as long he or she has had continous leave since then. as far as I know there isn't anything to say that s...

Re: Second Interview - Student visa will complete 10 year IL

1. They can't refuse purely on the basis of the first interview. a second interview is called on the basis of concerns raised by the first one. having a second interview doesn't automatically mean you you will be refused but there is a significant chance you will be. 2. this is almost certainly the ...
