Re: NEW EEA Regulation that violates EU law coming into eff

In reality the caseworkers seem to have been working to these rules for a while now, they are finally spelling out what they have been doing (perhaps the Gina Miller High Court ruling did teach them something about the rule of law). From the SS Facebook groups I have noticed that a lot of people who...

Re: New EU deal: Free-movement rights gone?

How long is a piece if string. Depends on the local office. The EU needs to get their green NIE card first which is relatively easy though if you're self employed you will need evidence of this from the department of social security. Once you have the green NIE card from the National Police toddle i...

Re: New EU deal: Free-movement rights gone?

The idea of "prior lawful residence" will make things more difficult but not impossible. About half of EU states apply the same rules to spouses of EU citizens as they do their own citizens. Even those who have stricter rules are nowhere near as bad as the ones in the UK. When we applied for my wife...

Re: Possible barriers to Surrinder Singh – any solutions?

The EEA national needs to exercise treaty rights, being a student does that. Getting married massively helps and it would allow you to work while the UK RC is pending. Don't worry about living together before marriage it will have no effect at all. Where you get married is immaterial too. If you can...

Re: EEA2 Application Timelines - ONLY 1 TOPIC - UpToDate

I should say really, we have been so over the moon since receiving the letter confirming an RC is on the way, thank you to everyone on this forum. I have been lurking on here for years, from when I lived in China, through our SS journey through Spain and then back to the UK. The advice on here is ou...

Depends on which country you go to and what your sponsor plans to do. It will only be an issue when you apply for an Article 10 RC.

Hi everyone, i'm new here but i have been following this forum for a while now and i find good informations here. Re: EEA2 Application Timelines - ONLY 1 TOPIC - UpToDate

DNA tests are usually done by swabbing the inside of the mouth but they can be done through a blood test or hair sample as well. I doubt the Home Office will believe there is a medical reason why it can't be done.

Re: EEA Family Permit refusal reasons?

Can you post the refusal letter? This £153 thing has me worried, as we used the SS route from Spain. Over there it can be pretty dodgy with less money declared on your payslip and topped up with cash in hand. My payslips only showed 900 Euro a month which is only just over £154 and can be less if th...

Re: UKBA To Charge For EEA Applications

When Mrs Dirk applied for her RC in Spain they charged us €10.60 which is the same charge leveled against Spanish citizens for a National ID card. We do not have a National ID card so they have chosen the passport as the item to charge a similar fee too which is £72.50. With biometric enrollment you...

Re: EEA Family Permit refusal reasons?

Hi benfare how to submit a to SOLVIT and EU Commission? The UK Government would say that because you submitted evidence which suggests your wife was in a relationship with someone else they have reasonable grounds to refuse you as being in a sham marriage. In your rejection letter it says that the ...

Re: Code 1a Stamp Using Schengen State !!!!!!! Help Me Pleas

The UK is not part of the Schengen area so a separate visa is needed. Under your circumstances this is the EEA Family Permit. You have been told how to comply with the rules and get in but have consistently tried to look for a loophole or a way around It you are in a genuine marriage it should not b...

Your intentions after you get the stamp have no relevance really. Llike I have said several times you will need lots of new evidence of being in a real marriage.

Re: Code 1a Stamp Using Schengen State !!!!!!! Help Me Pleas

Personally in your situation I would go for the ferry at Calais as it is cheap and if you miss it you won't waste a lot of money. You really did a bad job with your last application and you have given them a strong reason to think it is not a real marriage. Remember the rules for a 1A are the same a...

Re: Code 1a Stamp Using Schengen State !!!!!!! Help Me Pleas

You must have posted the letter at the same time as I posted my message.

It seems the emails you provided make it appear as a sham matriage. Emails not addressed to you dated from before you met.

I think you need to live with her somewhere for a while first then teapply.

Mortgage statement? Tax statements? You really need to tell us on this forum what EXACTLY they wrote on the r...
