Under tier 2, you are supposed to be the employee of the sponsorship company and the sponsorship company is required to pay you the salary stated on the CoS/visa application. Are they still paying you the salary? Did you have to pay them before they would sponsor you? How much of your contract rate ...

What happened between November 2010 and March 2011? Were you still working in the UK but not getting payslips? It sounds like your company was treating July to October as a business visit and not employment, and also assuming you were not tax resident in the UK for that period. Maybe one of the expe...

You may want to look up the recent (from the summer) Owolabi and R Alvi cases. The tribunals found that the tier 2 visa could not be refused based on the job and salaries listed in the codes of practice. The decisions seem to be based on the fact that the codes of practice are not lawful as they hav...

The umbrella company is going to take you on as an employee and sponsor you. When they apply for the CoS, then they will ned to state the salary that they will pay you and that must be at or above the appropriate rate. If they sponsor you and are relying on you to find contract work via agencies, th...

As far as I understand it, the 12 month cooling off period only applies if you were on a shorter term ICT visa and want to return on a shorter term ICT visa, or if you are were on a longer term ICT visa and want to return on an ICT visa. It does not apply if returning under tier 2 general, or if you...

@sarath1212 I agree that it is unclear if the UKBA will allow switching to tier 2 general for pre 06-04-2011 ICTs. You could try contacting them and post the answer. However the cap for tier 2 general (20,700) is high for the first year. There were only 8,555 entry clearances for tier 2 general in 2...

As an ICT, there are tax relief benefits for the first two years. The agreemememt is more likely with HMRC.

You can switch but that that may change soon.

Good luck.

The lowest suggested cap for tier 1 is 8000 which , pro rata, is actually an increase over the interim cap.

Although tier 1 takes a bigger share of the cut, it is now shared with ICTs.
If ICTs are excluded and the cuts are redistributed then tier 1 will drop significantly.

The interesting point is that it refunded after you pay taxes so in the long run it costs nothing but reassures Daily Mail readers that the people coming in are good taxpayers (like the vast majority of people on tier 1).

It is the reason why those on tier 1 should be encouraged and welcomed.

How is your actual salary different from your P60? Your P60 should show gross and deductions and that should match your payslips. I think it has been mentioned before that this company does not provide proper payslips that you are legally entitled to. It sounds like you would qualify if you can get ...
