I would just be careful and 320 7a well is disregarded at the discretion of the ECO. if u get a meanie like me then you will be refused and can be refused for the slightest thing. so make sure you cover all basis this eplaination should have backup if u can explain and back it up. well did ur hubby leave before the 1st of 2008. cos there was a concession for people who had overstayed but left the country before the 1st of oct 2008. the overstay wouldnt be used against him. however if he was rejected becos he left after 1st oct.

john's advice is good go to a few hearings.

honestly the decision to ignore u are a overstayer is at the discretion of the ECO. so don't take the fact that u could be refused for granted.I would advise u to take everything u have. so my appeal was allowed and presenting officer didnt contest the decision sent an email to the post last wed and yet post claims they didnt receive anything to date. yet UKBA was saying that they emailed the determination i dont understand if UKBA was lying or the post.so i called the post everyday...
