Re: Less Than 2.5 yrs before FLR(M)

I think you should ask them to correct any mistakes the sooner, the better, well before any extension application. Then, hopefully, you should have your documents back in time before your leave expires. If you apply for an extension by post shortly before you leave expires, then your leave is exten...

Re: Less Than 2.5 yrs before FLR(M)

If they ignored your requested date of travel, then you should ask them to correct it. Else, you may have to pay for an extra extension to complete the 5 years qualifying period. Applying for an extension in-time by post may give you some more time, depending on how slow/fast they are before decidi...

Re: Less Than 2.5 yrs before FLR(M)

Thanks Vinny for the quick reply. Evidence of subsisting marriage is not an issue as we've not lived apart even a single day and have enough documentary proof. I just hope that when i apply for the FLR(M), that i will not have an issue with the late arrival. If I can get past that, i'm guessing that...

Less Than 2.5 yrs before FLR(M)

I was granted a spouse visa in February 2016. I was living with my wife and Child overseas (Both BCs) so we made a trip in March 2016 to collect my BRP but came straight back as we had lots of stuff to finish before we could move in May (we had requested the travel date as May, but the HO gave us 30...

Hi everyone, My visa was granted in less than a month and mine is hardly a regular case. I hope this will encourage others in similar situations, 2009 - Overstayer came back on my own accord 2009 - Applied for unmarried partner visa from Sri Lanka & was granted the visa under the old rules sadly cir...

Re: New member advice

Hi sorry to jump in with a question, i thought i'd ask here rather than open a new thread. Even though i only need A1 for a spouse visa application, would it be a problem if i take the B1 test instead? All the A1 slots are filled up and i have to wait a while to sit for the next available A1 test, ...

Re: Right of Abode actual wait times (2015)

It does seem strange, but getting the ROA certificate from overseas is definitely quicker. We applied for the ROA for our son from Sri Lanka via the VFS office in Colombo which sends all applications to the Chinnai (India) deputy high commission for processing. Exactly 10 days after submitting the a...

Spouse Visa Application - Proof of UK Citizenship for son

We would appreciate some advise on the following, My wife (British Citizen via Naturalisation) and myself (non Eu husband), both living outside of the EU, plan to apply for a Spouse visa later this year. We have a 2 year old son who was born outside the UK after my wife was naturalised as a British ...

Proceeds from sale of property - Savings Route

In order to satisfy the financial requirements of the spouse visa, we sold some land and as we only intend applying in about 3-6 months from now, have invested this money. I hope someone can clarify some concerns i have about how this money could be invested and used to show that we satisfy the req...

Re: Expired Spouse Visa, Refused visit Visa, what should we

Slightly off topic as I'm back on the NHS debt issue. The link below seem to be HO guidelines for ECO's. Page 63 is on visa refusal based on NHS debt.

http://alturl.com/mbxbs

If the above document is correct, how come people get refused for much older debt?

Re: Expired Spouse Visa, Refused visit Visa, what should we

We just re-read Amber's original post, so what you suggest is that we do not apply for another new spouse visa but instead apply for ILR based on the original unmarried partner visa? The actual reason was the fact that our parents were ill. I can get a letter from a doctor to that effect as well. Bu...

Re: Expired Spouse Visa, Refused visit Visa, what should we

Thanks Amber for the advise. We are trying to make sure that we can get to the UK again with a new spouse visa so we can apply for ILR. But this NHS question has us worried. Also, we are the same couple from the onset. Only difference is that now we are married and have a child. When we applied for ...

Re: Expired Spouse Visa, Refused visit Visa, what should we

Thanks a lot vinny. So, based on the statement of changes to immigration rules (https://www.gov.uk/government/publications/statement-of-changes-to-the-immigration-rules-hc1511-10-october-2011) the rule can only be applied if Refusing entry or stay NHS 7.17 The Immigration Rules change will provide t...

Spousal Visa - NHS Bills Question

Can somebody who knows please shed some light on the grounds for visa refusal based on unpaid NHS bills ? From what i have read, this applied to bills incurred on or after the 1st of November 2011. If this is correct, any charges prior to this date cannot be used as a reason for refusal. http://www....

Re: Expired Spouse Visa, Refused visit Visa, what should we

Good to know that the accommodation plan is acceptable, we'll start collecting the required documents for that asap. I'm ok with the £600 nhs surcharge, hopefully someone can also clarify if my using NHS for free prior to 2011 would be an issue. If so, how do I resolve it?

Re: Expired Spouse Visa, Refused visit Visa, what should we

Many thanks for your reply. We will have to keep the £62500/- savings for another two months to get past the 6 months requirement, but it'll take us about that long to get the accommodation proof sorted. We hope to get a letter from a friend who has a 6 bed-roomed house (only two people living there...

Expired Spouse Visa, Refused visit Visa, what should we do?

I arrived in the UK in 2000 on a visit visa and subsequently applied for asylum. My application was denied and i also lost the appeal. I was asked to return in 28 days but i overstayed. Instead i sent many appeals to the HO as i was genuinely scared to return to my country. During the time in the UK...

Advise appreciated with my 'unmarried partner' visa

I was a failed asylum seeker living illegally in the UK for about 8 years (entry to the UK was legal). I was in a relationship with someone who was then a foreign student, but subsequently got citizenship (10 years as a student, ILR and then citizenship). We applied for unmarried partner status from...
