As per the last info. published on the UKBA website (that's been taken off since the new govt. was sworn in), migrants covered by HSMP JR (as you) will not be affected by the new immigration changes (probationary citizenship). Migrants who applied to the highly skilled migrant programme between 3 A...

The changes are meant to happen in July 2011 so you may or may not slip through. The changes (July 2011 laws) were not meant for HSMP migrants prior to November 2006. Hence, this does not affect HSMP immigrants prior to Nov 2006 but will affect any immigrant post Nov 2006. I hope this clarifies. If...

Yes it does. but this non-resident status is less than 6 months and as per annex f it qualifies for discretion. thanks regards I think aaa123 needs to have retrospection in to reading English else, the individual would not have judgement on his/her prejudice for vehemently sustained information whi...

Are you sure about this? I think I read somewhere that after July 2011, ILR will be replaced by Permanent Residency (which is equivalent), and you will still have the option to apply for PR instead of Citizenship. PR does not stand for Permanent residency. It means probationary citizenship which is...

My understanding is that after your initial 2 years spouse visa (or 5 years work visa), you will move to Probationary Citizenship (PC) for a minimum of 1 year (for those doing community work) and a maximum of 3 years. After your PC, you qualify for Citizenship. So you can still get Citizenship afte...

I got my HSMP Visa stamped today along with my husband and daughter. I plan to leave to UK in Mid June 2010
There is no HSMP anymore. It must be Tier 1 visa. Huge difference between HSMP and Tier 1 for the current rules.

Congratulations anyway

Provided the rules remain in July 2011. If you apply prior to changes in July you will get ILR else you shall receive probationary citizenship.

Thanks for this valuable info. Does this mean my initial almost 2 years of stay in UK (thru Work visa) will not be counted as a part of my 5 years, when i apply for permanent or probationary citizenship? I don't agree. Please read the original post again. The individual was on work permit and out of UK on work which means legally in the system. When one switches to HSMP, clock only resets if you are out of the country and not on any valid visa. Now. You got me wrong on this. Reading this further, y...

Anyways, simple answer to your question is NO. It won't affect you as you are covered by HSMP JR pre November 2006 rules. I hope you can rest in peace now.

Does my initial workpermit year count towards ILR? I am not planning to spend more than 450 days out of UK but worry is the 2 months (paid) employment in India, followed by 2 and half months of break. (This totals to around 135 days). However, I was always on a valid visa with no breaks and initial...
