Re: Tier 1 General Extension - Missed April Deadline

Some people have expressed interest, but it is not strong enough, in my estimate we need to have a sizeable warchest of funds before proceeding with a JR filing.

Re: Tier 1 General Extension - Missed April Deadline

There is no 'right' to be in the UK except for native born UK citizens. Even naturalized citizens can have their citizen stripped and subsequently be deported. As a sovereign nation, this a decision they can make at any time. There is something called a right to fair treatment, and that is a basic ...

Re: Tier 1 General Extension - Missed April Deadline

Nobody has dared to challenge the Home Office legally but in my personal view, we stand a good chance if we do (however I am not a legal professional so we also need professional help which is likely to cost a bit). Anyone who is interested in joining up to legally challenge these fee increases and ...

Re: Help with Tier 1 genera to ILR, 15 month qualifying peri

The date on the payslip does not have to be the same as that of the salary payment. The income must pertain to the period claimed i.e. you cant claim the income of Nov-2013 as the income of Dec-2013 just because it was paid in Dec-2013.

Take professional advice if required.

Re: ILR or Extension_Kindly help

Thanks for the confirmation from Home Office. Others may benefit from knowing it. As far as I am aware, you need to have an active T1G visa on the day you apply for ILR, and you need to prove that you have a minimum of 5 years (minus 28 days) of continuous stay when you apply, after all acceptable a...

Re: ILR or Extension_Kindly help

1. Yes, however 16Apr2010 is the date your visa is valid from, not your date of initial entry. 2. Yes, because you may apply for ILR 28 days before you complete 5 years continuous residence from the date of your initial visa. 3. Better to get, but going by the information supplied it may not matter ...

Hello All, Help wanted!!! I applied for my initial Tier 1 visa on 9th of July 2010 and received it on 30th July 2010. Came into the UK 2nd October 2010. My challenge now is that I will be due for ILR 2015 but have long absence total 283 which is 103 days more than the accepted 180 days between Nove...

You appear to be eligible for ILR when your current Tier 1 leave expires, assuming you dont fail in the other requirements like earnings, general grounds of refusal etc.

Unless a Judicial review is filed against this policy of closing T1G renewals, a very large number of applicants are going to get affected. Re: Tier 1 General Ext only until 2015

Anyone who wants to consider the court route should be aware that Judicial Reviews can cost tens of thousands of pounds. So let's say £50k.

How many here are willing to contribute £500 each (we need a minimum of 100 such members).

Re: Tier 1 General Ext only until 2014

This is why we need to fight all retrospective changes that the government is making - when we got the visa, we were not led to believe that Tier 1 renewal would only be allowed until a particular date. Four people including me have agreed to contribute £500 each to pursue a JR against these retrosp...

Re: Another Fee increase by the UKBA

We will need to file a JR to combat this... and I am convinced that the government has no right to discriminate on the basis of nationality by raising taxes through this backdoor route (to subsidize the general population)... charging above cost is in my personal understanding very likely illegal. I...
