residence card lost/stolen whilst abroad

This is a theoretical question that always occurs to me: what do you do when your non-eu wife has their residence card stolen when outside the uk? Are you now stuck in that country? Do you speak to the british embassy? Assume you have other proof of id and a marriage certificate with you to prove yo...

Thank you. Trying to be the devil's advocate here: If you take into account the McCarthy case and decision and sticking to the pure definition on nationality (by birth) vs citizenship (acquired via naturalisation), could one argue that this change does not apply to EEA nationals, who still exercise ...

In our case: - Me (EEA Greek National exercising treaty rights, married to non-EEA wife) - Applied for and given Residence Card one year ago for my wife (on an A4 sheet, as her passport was expired at that time) - Concerned about the situation in Greece, I applied and I naturalized as a British Citi...

I am writing this last message to give you the details of the happy ending to our story. End of July our Immigration Lawyer applied for an appeal against UKBA's and the SIO's decision to issue a decision for removal and liability for detention and removal (form IS151A). We were issued with a date fo...

Yes they can, but they will need to provide strong evidence (tenancy agreements in both names, bills in both names at at th...

I agree with Obie but insinuating and proving a marriage of convenience is extremely difficult for UKBA and the instructions say that a very detailed evaluation of all factors must be made by UKBA before they do prove this. In essence, after the fact (wedding) I think it is very difficult to prove a...

We have not yet received an answer for our EEA2 application (so this is why they did ask him and my spouse to report, until it is decided what happens with their case). So long as you are married, an application cannot be refused. And as long as you are married, she is lawfully here in the UK regard...

Thanks, yes I did read this and was just about to respond to the poster.

I do not believe it is a new policy, our solicitor advised us that they have done it in a number of cases with their other clients.

It is cheap publicity for them to look better, let them blow some steam!

This situation with the return of the passports is bound to create a big problem, for all of us (we are in the same boat) who want to go to the registrar and get married. But she has: Medical Card (what this is, is the NHS card you get from your GP, although no photo on it, it is listed as "acceptable" on the Westminster council, if it is to go along with the birth certificate). I thought it'd be useful if I were to give you some updates on our case. Using the services of a solicitor, we applied for a Certificate of Approval and an EEA2 (Durable Relationship) in early March. We received acknolwedgements for both applications in late March. As you probably know, on 9 May the...

The issue with your expired visa should be an issue because if you prove you are an extended family member of an EU national, exercising treaty rights in the UK, your current visa status becomes irrelevant - the hard ...

I know it is not much help now, but why didn't you put an application for EEA2 as "durable relationship" at the same time when you sent the COA application? Since you appear to have strong supporting documents that your relationship is genuine, you would have waited 6 months and would have gotten th...
