UKBA can only refuse if you have a unspent conviction, so if the 5 years is up then u do not need to worry.

I had a reply after several letters and emails, apologising for the delay and saying that the due to the huge volume of backlog plus stating that application is still under consideration. so why is it taking them 3-4 weeks to process those straightforward applications which has been affected by the IT issue? doesnt it look like they are just shoving all these IT affected applications to a corner and taking on more applications which is causing this delay?

so once the system is back up and running why arent they giving priority to those whos applications have been delayed?? there are a few people on this forum who has been waiting nearly 3 weeks now!! they are spreading this IT issues to other PEO's to make it look like its a genuine problem! disgrace...

I am guessing you hold a spouse visa. If yes then you can apply 28 days before you complete the 2 years stay in the UK, you won't have to wait till your current visa expires. So in your case you should be able to apply for ILR in May/June 2012.
