Re: Biometric Residence Permit Renew

Thanks for this, it’s very hard to find any info. Could you please share the list of acceptable documents for proving continuous residence? I have been keeping my council tax bills and utility bills but don’t have much else (aside from bank statements). It’s been hard to compile even this as nobody...

Re: Biometric Residence Permit Renew

Thank you for your questions. Re documents we used her P60s to prove 11 years work (we scaned each year ), and council tax bill for 11 years. I also have utility bills but did not need to submit them. Also I sent a summary of all her absence from UK for 10 years plus scans of her old passports. IN ...

Re: Biometric Residence Permit Renew

Our experience for BRP Renewal in UK from January 2022 I have written this to try to help others going through this same process. We are in the process of renewing my wife's ILR 10 year BRP which is due for renewal in Early April 2022. Please note that we were one of the early ILR applicants in 201...

Re: Using egate with new passport not yet linked to BRP

Yes, legally I don’t think they are linked, but from a practical perspective I understand the passport number and BRP number are linked in the border system. The whole thing would be more straight forward if they required us to update our passport numbers as they do for EU settled status. Although I...

Re: Using egate with new passport not yet linked to BRP

I'm sure you can join the queue (which will take longer of course) - also there is or should normally be at least one officer overseeing the egates operation and who would process you if you won't be passed through. Happened to me once but that was because for some reason my passport was not recogn...

Using egate with new passport not yet linked to BRP

Hi there, I’m an ILR holder about to travel outside the U.K. for the first time in 4 years. I’m Australian and I understand when I arrive back in the U.K. I’m now likely to be required to use the egate terminals rather than have my passport manually processed by an immigration officer. My concern is...

Can this many people really have been engaging in tax deception?

That is stunning, and depressing. When are the next lot out? I think they might be even worse based on the threads in this forum.

Re: Proposed change in rule - Tier2 dependent work

I don't think anyone know the answer to your (good) question. And we won't know for months. It's most likely going to be a case of changing work rights from the date of a visa being issued (or extended). There is an outside possibility they might be nice and grandfather it so it only applies to peop...

The impact of 7.6 could be interesting. Are they going to interview everyone currently on Tier 1 to re-validate their circumstances as appropriate under the visa? which para is it can you please paste the whole para here please. Thanks So far, they are more interested to interview those who are sel...

Re: Tier 1 General Ext only until 2015

Just my opinion but from some things I read I think the intention with the five years clause is not to encompass people with absences but rather to encompass people that had long winded appeals on their initial grant (back in late 2010, early 2011), and who wouldn't make it to 5 years by April 2015 ...

Re: New rules to Tier 1 (general): 3-5 years for 2nd extensi

The rules read as 3 years or the balance of what you need to be granted enough time for settlement, which ever is longer. So it's not a maximum of 3 years, it's a minimum of 3 years. In almost all cases it will be 3 years.

Re: New rules to Tier 1 (general): 3-5 years for 2nd extensi

What does that even mean? Is that saying that they will be not trying to work out the time to settlement eligibility as all that matters is that the applicant be granted 5 years all up, irrespective of absences? That is how I read it. In which case no one will get more than the alternative 3 years (...

Re: New rules to Tier 1 (general): 3-5 years for 2nd extensi

I don't think they were giving 3 years to everyone previously. I've seen plenty of reports of 2 year extensions, and when we called the help line they said they alternate extension lengths, you get 3 then you get 2 then you get 3 etc. By that logic we were due a 2 year extension, so I'm very pleased...

Re: New rules to Tier 1 (general): 3-5 years for 2nd extensi

It's good to see that our reading was right. The new rule is now there in the updated Immigration Rules, so that we can cite it to the UKBA staff if necessary: 245CB. Period and conditions of grant (a) Leave to remain will be granted for: (i) a period of 3 years, or (ii) the period the applicant nee...

Re: New rules to Tier 1 (general): 3-5 years for 2nd extensi

The new rule is not coming in until the 6th of November per my reading, so I guess it's not surprising that the helpline people are not all up with what's going on (though they should be, and it's reassuring to hear that at least one guy is aware of it). On that date we should be able to see it in b...

Re: New rules to Tier 1 (general): 3-5 years for 2nd extensi

Yeah there no need to panic. The fact they are introducing this rule for longer extensions shows relatively good intentions toward the category as it closes IMO. There's only six months to go anyway, diminishing returns on doing anything nasty and all that.

Have you heard anything specific that has made you worry? Cutting early extensions is something I've been concerned about for a while. Feel like I'm playing Russian Roulette waiting for so long to extend (planning to extend in January, visa expires in November 2015).

Re: New rules to Tier 1 (general): 3-5 years for 2nd extensi

No, not that I saw Go12. I'm paranoid about that too, but given this change it looks like they are being quite generous about allowing current Tier 1 (general) to get to ILR so I doubt they will do something that nasty with only a few months left before closure of extensions. The main reason they ru...

Re: New rules to Tier 1 (general): 3-5 years for 2nd extensi

Incidentally if you have a look the Immigration Rules were updated on the 20th of October and the changes that were due to be made then (those pertaining to paragraphs 1, 7, 18, 64, 66, 97 to 98, 100 to 109, and 168 of the statement of changes) appear to have been - albeit sometimes rather sloppily ...

Re: New rules to Tier 1 (general): 3-5 years for 2nd extensi

The relevant paragraph we've been reading is in the explanatory memorandum, under the sub-heading of "Policy Context" so at first I thought they were just maybe flagging future changes. But the immigration rules are explicitly changed in the earlier statement of actual regulation change: 4...

3 years is consistent with recent interpretations of the rules.

Re: Tier 1 General Ext only until 2015

We called the UKBA about the length of extension thing last year, when there were first rumours about extensions closing in 2014, and they said they normally alternate. So if you got an initial grant of 2 years, then you get 3, then you get 2 etc. This is consistent with what our solicitor has told ...

Re: Tier 1 General Ext only until 2015

We also arrived in August 2011, having taken time to secure employment before arriving. Original visa grant was November 2010. I'm not overly worried about this as I've been expecting it pretty much from the start, it's a defunct visa category and the current government is obsessed with bringing dow...
