Timescales for refund of application fees

Hi I received a letter at the start of November 2010 from the UKBA informing me that my application was invalid and noting that arrangements had been made to return my fee. However, it has been over 4 months now and I have still not received my fee. Please could someone confirm the average ...

If your ILR application was under consideration during this period you were not illegal during that time slot. Unfortunately, the immigration status continues only while the UKBA processes a valid application. My first application was invalid so technically I was an overstayer from September 2010 ...

residential requirements

Hi I entered the UK in August 2005 on a work permit visa and became eligible to apply for Indefinite Leave to Remain in the UK in August 2010. I first applied in July 2010 (within 28 days of my becoming eligible in August 2010 as required) but there was an issue with my application which made it ...

As per my understanding, both invalid applications and out-of-time applications do not have Section 3C protection. To benefit, a person must have existing leave to enter or remain at the time when their valid application is made. Therefore, in your case , unless the initial application is deemed ...

Subject to paragraph 320(7C) (see RFL5.4 ),... ‘Overstaying’ means the applicant has overstayed their leave to enter / remain, not just stayed longer than they said they would. The rule requires that the applicant has overstayed for more than 28 days (or for any period if, after overstaying, he ...

Overstaying

Hi I've just learnt that overstayers are banned from the UK for at least a year. My question is, when does a person become an overstayer? I applied for settlement before my visa ended but they rejected my application as invalid. I thought that my permitted stay was extended until the UKBA reached a ...

Eligibility

Hi I was eligible to apply for ILR after working in the UK for 5 years on a work permit visa. My application was invalid and returned to me after my visa expired. I have reapplied, asking for a reconsideration. If this is not successful and I leave the UK and re-apply to enter on a Tier 2 visa (I am ...

This happened to me and I was told I would get the money back in about 30-35 days.

What are you doing now? Re-applying?

Provide the missing information ASAP . Request for discretion under 18.2 that the initial application be treated as valid. Thanks I'll do that and let you know how it goes. If it turns out that I have to go back to my country, what impact would all this have on my application for leave to enter and ...

Note that 18.2 However, where there has been an unacceptably long delay (that is, more than 3 months) before the validity of the application is considered, discretion should be exercised and an application not rejected as invalid because it does not satisfy one or more of the mandatory requirements ...

Hi Janedoe
I was wondering how you were getting on.
I learnt today that my application was valid. This comes 3 months after my initial application and 2 months after my visa expired.
Did you get legal advice about what to do next? What'd they say?
Thanks
Amy

Invalid application notification received after visa expired

Hi I applied for ILR before the end of my permitted stay but they just informed me that my application was invalid because I hadn't answered one question. It was dumb of me but I thought the question did not require answering because I had answered no to the previous question. Anyway, their letter ...
