Re: EEA4 Advice please

If you both continue to live until June 2016 then you don't need to show any evidence of treaty rights since she (EU national) is already a UK permanent resident. For this purpose you will simply need to send her PR confirmation certificate/card. Moreover, beyond to the date of achieving her PR she ...

Re: Almost at the verge of Apllying for PR befor ROR any Ad

You have already been advised correctly as your clock towards PR will only start where you had been recognized as the EU national family member. In your case if you had got RC on the basis of your cohabitation prior marrying then that period maybe counted towards PR. I am sure a lot of solicitors ma...

Then why don't you keep the process more easier by simply marrying in china and apply for his/her visa called EEAfamily permit under EU route which will be free.

Re: pls help

As told earlier in other similar thread that despite a non-eu national is still treated as EU family member even when he is being separated but still the 2nd RC application under such circumstances can be difficult to succeed. Therefore, if your eu partner agrees to help you then preferably you must...

Re: Eea family member

Getting another RC while being separated will involve an extremely risky process because HO may visit your home or call both for interview and if miraculously you got it then on your return at the airport can be asked about your partner. I think if your EU partner can provide you with her original p...

Re: Eea family member

The gap of 2 months between the jobs during 5 years will be bit difficult for caseworker to notice if you attach the 5 p60s. If unfortunately the caseworker refuse your application on such grounds then you may apply another 5 years RC with her latest treaty rights evidences even you are separated be...

Re: Using NHS and comprehensive sickness insurance

Private medical insurance works along with NHS and even without being registered with GP it can't be hired/bought. Moreover, in order to use private medical insurance policy the GP referral need. A lot of people are using NHS and at the moment ukba is not actively tracing that, therefore, if you kee...

Re: Almost at the verge of Apllying for PR befor ROR any Ad

Unfortunately you are not yet entitled for PR but you may qualify for ROR. Because your clock towards achieving PR had started from the time when you were recognized as the family member of EU national which is your date of wedding. Therefore, the time you spent prior to marrying won't be counted.

Re: eea residence card 'self sufficient'

There is no fixed threshold as the individual circumstances are usually considered but the funds must be sufficient to not to become burden on public funds. Most importantly the access of funds to EU national must be demonstrated and the CSI plan covers the whole family in majority of circumstances....

Re: Am I Eligible for ILR???

You won't be eligible for ILR based on 10 years of long residence due to refusals. Because usually the applications submitted under UK law cover by virtue of section 3C & 3D which avoid an applicant to become overstayer even after the end of their visa till the time when the appeal rights are fully ...

Re: Very Worried....I need advise Asap !!! (PR)

That question on the form should be answered accordingly but I still don't think that is there any need of attaching divorce certificate of previous marriage. Because your relationship/marriage has already been recognized and RC is its confirmation.

Re: Very Worried....I need advise Asap !!! (PR)

Why you are interested in sending the divorce certificate of previous marriage since your current relationship/marriage has already been accepted at RC stage? Therefore, it will be unnecessary for PR application.

Re: Is NIN nececcesary for self sufficient EEA2 app?

Having no NINO won't affect the application as long as the EU national partner is self sufficient and his funds/savings are enough for his family not to become burden on public funds. Apart of that you will need to buy CSI covering the whole family. Also keep in mind that the first 3 months since ar...

Yes. An eu national can become self sufficient on the income he/she has been receiving from French employer. For this purpose the CSI covering the whole family will be needed.

Re: 5 years from Marriage date or Visa date ?

The correct route is PR under eu route instead of ILR and your clock towards getting the PR was started from the day of marriage as long as your eu partner was a qualified person during the last 5 years as well as was not absent for more than 6 months in any year.

You will have to have passport in order to proceed to application for PR. For this purpose you won't need to apply residence permit but you can be asked by caseworker to produce evidences regarding your residence for such period??

There is no minimum threshold for worker as long as the work is an effective and genuine activity. Usually 24 hours/£149 per week is considered as effective and genuine activity by the UK benefits authority.

Re: PR (EEA4) do I need a visa to travel to EU countries?

By virtue of article 20 EU directive 38/2004, you can travel although some airline staff may deny to let boarding. See few examples as its confirmation: http://www.mfa.gov.lv/en/london/entry-into-latvia/documents-required-for-a-visa-applications-of-a-family-member-of-eu-eea-national http://www.mzv.c...

Re: EEA2 Procedure advice needed

If you are a non-visa national to UK then better you apply eea2 RC once you return. And if you are a visa national then if you travel outside of England and if your current EEA family permit is expiring then more likely you will need another EEA family permit before entering. Remember, eea2 RC is a ...

If the polish state insurance is not an EHIC health card (the one usually an EU country issue to its nationals but in uk it is only valid if the stay is temporary) then it must cover you in UK in majority of health related circumstances throughout the period when you were living as a student.
