Re: Fresh application while JR is pending

Amber...thanks for the confirmation. There was no appeal right, so straightaway filed the JR after PAP.

Is it ok to make a fresh application without withdrawing the JR?

Re: Fresh application while JR is pending

Yes Amber, that's what I wanted you to confirm. Sorry, my query was not clear. When a fresh application is allowed while the appeal is pending, same way can we make a fresh application while the JR is still pending at the court witout withdrawing the JR ? It is an in-country application and the curr...

Re: Fresh application while JR is pending

Hi Amber,

Could you please clarify whether I can make a fresh application while JR is pending and I have valid leave for another 4 months. Is it possible to apply without withdrawing the JR?

Thanks.

Re: Fresh application while JR is pending

Hi Vinny & Amber,

Please share your views. The information given in the Policy Guidance contradicts from the UKBA Immigration rules. How to clarify?

Thanks.

Fresh application while JR is pending

Hi Vinny & Amber, Could you please clarify whether making a fresh application is allowed while the Judicial Review for the initial application is pending? (The current visa is still valid for another 4 months) APL1.20 Applicant makes fresh application while an appeal is outstanding A person who has ...

Re: When to apply for Tier 2 general extension

Manci...I need some advice. I received my Tier 2 extension couple of weeks back and it is valid till April 2017. I will be completing 5 years in Tier 2 in Aug 2016 but I will be eligible to apply for ILR in Oct 2014 by way of Long Residence. My wife came to UK in 2005 and has been my dependant since...

Re: ILR Application: Over-18 Dependent

Raghavsey, The solicitor's advice is not a good option, he cannot give you any precedents. Better apply straightforward, anyway you are going with your parents for the PEO appointment and if there is any query regarding your independent life, tell the caseworker that you are staying away from home d...

Re: ILR Application: Over-18 Dependent

Raghavsey, May not be a good idea, it amounts to deception as you are hiding the fact that you are employed. At the PEO interview, the case worker can easily find out your employment history by entering your NI number and you will be in a tight spot. You have fulfilled all the other conditions and y...

Re: When to apply for Tier 2 general extension

Send the whole application form unless instructed otherwise. Make sure it is the correct version, anyway you will be getting the link when UKBA send you the email. No need to send payslips, bank statements and language proof. Use special delivery.

All the best.

Re: ILR Application: Over-18 Dependent

Raghavsey, You have not formed a separate family unit and you are staying away from your parents because of job compulsions, that should not mean you are not living with your parents. Having fulfilled all the other conditions, you should be granted the visa, otherwise you have to go for appeal. When...

Re: ILR Application: Over-18 Dependent

Hi raghavsey, It is clearly specified in Immigration Rules that dependants over 18 can take full time employment and need not be financially dependent on their parents but must not be living away from home and not be married or having a partner and wholly dependent upon their parents for emotional s...

Re: ILR Application: Over-18 Dependent

Hi raghavsey, These guidelines came into force in Oct 1994. Have you verified whether it is the updated version and the latest one? If it is the recent guideline, it will really be helpful for young adults who turn 18 and get into full time employment and find it difficult to extend the visa as they...

Re: When to apply for Tier 2 general extension

The start date cannot be in the past. If the migrant is already working for you and you are assigning the CoS so that they can apply to extend their stay, you should enter a start date no later than the day after the last day of leave given on their current visa. Please note that the migrant cannot...

psw2009... 160. A CoS assigned by you under Tier 2 and/or Tier 5 is valid for three months from the date it was assigned. During this three month period a migrant intending to come to the UK under Tier 2 or Tier 5, or apply for worker authorisation (Croatian nationals only) cannot be assigned anothe...

PSW2009, that is not true. You can apply to extend your Tier 2 anytime before the expiry of the visa and it has been confirmed by Manci in this same page.

Re: When to apply for Tier 2 general extension

Should I send the bank statement for proof of funds though it is Tier 2 Gen extension? 4. Can I make t...

Re: When to apply for Tier 2 general extension

Hi Manci,

I am applying for Tier 2 extension using the Priority Postal Service. I am not able to apply online as only the paper form is available for Tier 2 Priority, where as prior to Oct 2013, the application had to done online. Am I missing something?

Thanks.
