Good Character Requirements - overstayer

I am preparing to apply for British Citizenship and wanted to get your thoughts on the 10 years good character requirements for overstayers. By way of context: 1) I overstayed my student visa from March 2009 until September 2010. 2) In September 2010, I was apprehended by immigration officers and wa...

Re: ILR after 6 years DLR by PEO appointment

I'm not a lawyer but from the policy guidance all you have listed should suffice. I didn't use as much as you have listed but what's key is that you can demonstrate the relationship still exists and the intention is for it to continue and I think you will be fine from the perspective of proving rel...

Re: ILR after 6 years DLR by PEO appointment

As you have a significant relationship with your British child and playing a pivotal role (child lives with you, you are playing a role in her education and probably other things), you have a strong case.

Re: ILR after 6 years DLR by PEO appointment

You are able to apply for ILR from 06/06/2017 - end of Oct 2017. So whilst you have been eligible to apply since 06/06/2017 you haven't broken any rules. But you must apply before your leave expires.

Hope that helps.

Re: DLR to ILR but seperated briefly from hubby, claimed ben

Council tax isn't necessarily a mandatory document for the ILR. However if you were granted on the basis of relationship with your husband, then council tax with both of your names on would have helped in proving that you both are subsisting and living together (this is not the only document that ca...

Re: DLR and spouse

Quick update: I applied for ILR on the 9/6/2017 at the PEO and was successful. The whole process took approximately 90 mins. Brief context below: I was initially granted DL on 7/7/2011 and was subsequently granted an extension on 23/7/2014 to expire on the 23/7/2017. (All on the basis of my relation...

Re: DLR and spouse

Casa, Thank you for your response. I had assumed that only if it was benefit fraud (i.e. Charged and/or convicted etc) you did not need to declare. I'm morethan happy to declare as it was one those silly error where i got an annual pay increase of 3k and forgot to inform the council. But from your e...

DLR and spouse

I was granted DLR in July 2011 and should qualify for ILR July 2017. I was granted on the basis of having a bristish child for which I'm till playing an active role. I'm married to a non-EU national who is currently in the UK studying on a Tier 4 visa. In 2015, I was given an adminitrative penalty f...

That's exactly what it is at the moment... From the proposed amended regulation, it does say it would be Derivative right of resident.

All I'm suggesting is that in the future, it would be argued in the courts that it should lead to permanent.[/quote]

Well I doubt that it would be so eventually... Because you would not eg require one to leave the uk where one has a British child who is 1 yr old after residing in the uk legally for 17 years. Or assume before the child turns 18, the carer gets another child, making it a total of 35years in the uk. ...

Yes. Application can be made at the moment with FLR(o) form for a discretionary leave based on the ECJ Zambrano and Article 8, and also mention ZH Tanzania as they are all compliment to each other.

This is the only way at the moment, until ukba make provisions.
