Re: Judicial Review Timeline

I have my hearing at the first tier tribunal next month. The the tribunal had earlier directed the Home Office last December to forward their grounds for refusing my ILR to the court with a copy to my solicitors to arrive by a specified date. The date has now passed and nothing came through. Is the...

Re: EEA2 Application Timelines - ONLY 1 TOPIC - UpToDate

No interview or home visit. HO did not give any reason of delay after nearly 7 months. I am living with my EU national wife for 2+ years but married in June last year. I am laughing in hysteria at the UKBA reply to your inquiry, really 7 months justified? Well I have answer for her and I can guess ...

Re: 129 Pages EEA application for, what for

I suppose applicants could just ignore the form. write a letter of application, with all supporting documents, declaring their conviction status, and append it with a note saying the form is unnecessarily long, we simply do not have time to fill it. These lot do have issues understanding the differe...

Re: Visa free travel for Residence Card holder Case refer to

I would disregard Solvit reply , and the UK immigration rules. I would not be breaking the law, it is the UK who would be breaking the law if they refused me entry and in such situation, a claim will be definitely inevitable. If you aren't ready for a bit of scuffle, better apply for the FP, but for...

Re: please advise

Man you are messed up for sure, how have you allow the matter to get so out of hands? Are you on antidepressants? What would you do with yourself now when you get RC? you've just about destroyed yourself, something is not right about you. You need to do a trace back to where things went wrong.

Re: EEA family permit

Get him to send you as many documents as possible by email, ask them to confirm that, they are happy with the documents you have brought or they would require more? If they would require more tell them to give you some time to get your husband's tax record from HMRC that should solve the problem. Th...

Re: EEA family permit

Oh I missed this post :o , they need telling off these ECOs, did you receive the permit yet? The tribunal is now conveniently infringing article 6 of ECHR, how have you not been given a date since November? The whole lot needs overhauling seriously.

Re: EU national. How to settle in UK despite possible EU exi

If 2019 the earliest will happen, then obviously everyone who would not get PR until that date could be asked to leave or just be in a limbo where they can live and work but can't get settled, right? This is not the situation I would want to be in. So for that reason, discussion is not premature. U...

Re: EU national. How to settle in UK despite possible EU exi

There is route to permanent residency in Switzerland after 5 years of treaty rights, save for some Member States. https://www.bfm.admin.ch/bfm/en/home/themen/aufenthalt/eu_efta/ausweis_c_eu_efta.html If Britain left the EU/EEA, which is very very unlikely, there will be some sort of trade agreements ...

Re: EU national. How to settle in UK despite possible EU exi

Whilst I found the contribution of Yoshi very interesting and informative, I think I have been compelled to contribute to this thread, albeit in my view it's a bit like exacerbating the consequences of Brexit, and contrary to what many may like to think, freedom of movement is not a result of Britai...

Re: How Do I Renew EEA Route Residence Card Once in UK?

Did you read the link posted? You will need to apply for family permit valid for 6 months, when in UK, you will need to apply for EEA2 valid for 5 years, on expiry your partner may have automatically acquired permanent residence if he or she has not broken residence in the UK.

It's always been very clear, the UK courts just don't seem to have the courage to deliver the judgement, it's been done on their behalf.

Re: My attempt to enter UK via Calais on a German residency

what you have is Aufenthaltstitel and cannot be used in lieu of visa, an holder of an Aufenthaltskarte may seek to enter the UK without issues. What you have is as the result of your marriage to a German citizen, which is called a residence permit, an Aufenthalskarte is the residence card.

Unlikely you will get anywhere in the courts with that, a first order or permission, depending on where you live is very very unlikely, Keep at them, contact Linda Bateman, she may assist you if she is in the mood at the time your message reaches her.

Of course he/she should be drafting your letter before claim, that's why you are paying , because they have done this with someone else and got away with it, they have tried it on the next one and got away with it, it has become normal practice to ignore the burden placed on them by the treaties. The rights of an EEA worker in other member states and their family members are the same, any law that isn't applicable to an EU citizen is also not applicable to his/er family members.
