So the 'intent to live together' is very much open for interpretation. It's not something they will assess for FLR(M) - as you say it's kinda hard to prove. However they do assess it for SET(M) when you apply for ILR. At that point it's hard to say really - no-one has yet completed 5 years under th...

Guess the bit in bold is the main obstacle: Under regulation 9 of the 2006 Regulations, the family members of a British national returning to the UK will be treated as if they were the family members of an EEA national under the following conditions: After leaving the United Kingdom, the British nat...

Will her visa still be valid? Can't see it being an issue if so, and if she's not applying for anything herself at the time.

Those answers have helped Lekore except question 2. 2. Does she need to apply from 11th june (this week) or 27th july (1 month before visa expires)? You mentioned " BETWEEN 13/6/13 + 27/8/13 ", are you sure about this? That means as my wife arrived in the uk on 11th july 2011, she can apply from 28...

Agree with this, FLR(M) locks her into another 5 years and more strenuous checks and requirements, I'd avoid that personally tbh.

Had the same issue before. No-one seems sure if a BRP application is even logged onto the normal databases or not.

FLR(M) was really the correct application based on your circumstances. She did not have a spouse visa so SET(M) wasn't suitable. SET(O) as dependant of PBS migrant wouldn't have worked either as you didn't apply for your ILR under that category but went under 10yr LR - that allows no dependants unfo...

Kinda hard to read your post, but you should be able to apply together provided: you have a valid wp visa your wife has a matching dependant visa you've both been living together in the uk 5yrs+ (with a GOOD amount of documentary proof) both have life in the uk test passes If they have doubts alread...
