ILR return to UK before 2 year lapse

Hello All, Just checking what the current situation is with respect to a person with ILR returning to the UK within the 2 year period. I understand that the ILR does not lapse until 2 years away. Is there any advice on how this is understood by border officials. Most of the information in the "retur...

Re: Evidence of lawful residence - Draft employer letter

Thanks CR001 - that is very useful indeed. Given that there were also different employers in the missing period (and more than one letter will be needed), I think I'll follow you suggestion and use P60s. So for "evidence of lawful residence" we will have: 1.Passports 2. Crime reference number for st...

Re: Evidence of lawful residence - Draft employer letter

Thank you both
CR001 - I was planning on providing the crime reference, but wasn't aware of the P60 option. Is this mentioned in any of the guidelines, or is this more from other people's practice?

Evidence of lawful residence - Draft employer letter

Hi All, This is with respect to the "Evidence of lawful residence" required for naturalisation. My wife does not have all her passports covering the five year period: one was stolen a few years ago, so there is a gap of about 15 months where she does not have the required entry/exit stamps. She will...

Re: Returning Resident - Immigration Rule 20 and 2 year cloc

Thanks CR0001 - I'd agree that the resetting of the clock is not 'definite', but would to good to know your reading of the 9.3 discussion on 'visitor' which I have included in the original post.

Re: Returning Resident - Immigration Rule 20 and 2 year cloc

Would be good to hear from the senior members on this question, which I think affects many people. In the meanwhile, I found this on ordinary residence/ normal residence in the UK (mentioned in SET 9.3) https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/258236/ordinaryresidenc...

Returning Resident - Immigration Rule 20 and 2 year clock

I am an Indian national with ILR. I have been offered a 1 year work-contract abroad with the UN. My wife (also Indian national with ILR) will remain in the UK during this year, and I will therefore be travelling back to the UK at least 2-3 times for 1-2 weeks each time in the next year. As I underst...

Re: Lost (non current) passport - what documents needed

I didn't get any guidance here, but just in case someone finds this post, here's what I did: I gave the crime reference number in the form - where they asked for the previous passport I submitted a copy of the police letter (with crime reference number) and the biopage of the lost/stolen passport I ...

Lost (non current) passport - what documents needed

I am applying for ILR. I have completed over 5 years in the UK as a Tier 2 General migrant and I fulfill all the criteria. My previous passport (covering 1 year) and BRP was stolen in a burglary in 2013 and a complaint was lodged with the police - I have the crime reference number etc. The UKBA was ...

BRP replacement

Hi All, Our BRP was stolen - here are the dates for the replacement. Since most of the emails have horror stories, this might be reassuring to those who have applied. Date application posted - 13 March 2013 Date biometrics taken - 23 March 2013 Date documents returned (main applicant) - 20 April 201...

Thanks - that appears a reasonable interpretation.
In case you (or someone else reading this) come across something more definitive to support this interpretation, please do let me know.

hi Lucapooka,

While I am indeed referring to unpaid leave, Para 222 is not... If your reading is correct, then even paid leave for more than one calender month may lead to curtailment of visa.

Unpaid leave/ curtailment of visa

I am on a Tier 2 (General) visa and would like to take some time off on unpaid leave for some personal work. I intend to remain in the UK. Can someone clarify if this is allowed? I saw Para 222 of the Tier 2 Guidelines which states that the visa may be curtailed if "You cease to work for the Sponsor...

I have now written to the Law and Policy department via the public enquiries email (as suggested by the phone advisors). In case I get a reply, I will paste it here.

Thanks Vinny. Unfortunately when I called the UKBA this morning, I was told the opposite - and the partner needed to be on the dependant visa for 2 years. When I asked for the rule where it said so, they asked me to email the Law and Policy team at UKBA. I will try it... but would be helpful to know...

ILR for partner

I am a little unclear about the 2 year requirement for a wife/partner of a PBS Tier 2 when applying for ILR. 319E(c) requires that the partner must have or have last been granted leave as the Partner of the PBS migrant. AND 319E(d) requires that the partner and PBS migrant must have been living toge...

Dependent or Tier 2 - which is preferable for ILR

I am on a Tier 2 visa since September 2009, and my wife has been working on a Tier-2 dependent visa since January 2012. She has now got a job where it might be possible for her to get a separate Tier 2 visa (of course, she could also continue working on a dependent visa). We are not yet certain that...

Thanks Lukapooka, My CoS classifcation is "3539: Business and related associate professionals not elsewhere classified". Rather vague and unhelpful, unfortunately. Anyway, I shall try and figure it out. Thanks for the info about self-employment. Is there a source for this? I am aware that this is co...

supplementary employment

I understand that as a Tier 2 (General) holder, "supplementary employment" is allowed subject to a few conditions including, "as long as it is ... in the same profession and at the same professional level as the work for which your Certificate of Sponsorship was issued". 1. Where can I can get detai...
