Re: Changing from-10-year-route-to-5-year-route

Really? I was not aware that's possible. Based on the decisions made by UKVI, I believe the rule is clear whether on spouse route or child route, if you have overstayed, you will be given 10-yrs route to ILR. How can someone change to 5 years route?

Re: How to overturn a curtailment decision.

I shouldn't recommend but only hope for you reading your reply is asking for a divorce on grounds of cheating and abandonment. She will be due for an extension soon under 10 years route and would need your documents - that's only your ray of hope. If that 10 year route is curtailed then she has to a...

Re: How to overturn a curtailment decision.

Sorry to read your story and can empathize with you situation. You said "you guys got married in 2012" - if that's a case then she could have applied for settlement visa in 2015 because at that time settlement was granted in 3 years under spouse rule. In three years time, she will be legally here fo...

Re: Question about Spouse application

Totally agree, second marriage without a divorce is invalid in HO eyes. You should get absolute decree or vakalat nama for your first marriage. There is no way that there is no divorce certificate is obtainable as its certainly possible and without it your second marriage would be invalid under HO e...

Re: I am on a dependent visa....looking for divorce. need advice please.

I know it's not a great situation to be in. You said you will complete 10 years in June 2019. I am not sure but if they still provide one day premium ILR service for 10 years route, if not then you have to do postal which can take six months also. 2019 june. You can apply 28 days before your 10 year...

Sharma ji, why you making it so complex. You and your wife are living are in martial relationship. Since you are UK citizen, you can't get the EU settled status for your wife - you can try though. It's free and won't cost you anything. They usually issue it within 2 weeks. Surender singh route is no...

Re: No update from UKVI about spouse visa application yet

The challenge is inconsistency in the visa processing by UKVI. Process is not same for all countries. We sent documents from Switzerland on 09th Jan via TLS Contact (paid additional fees for TLS Contact), received by UKVI on 10th Jan. The email received says "Your visa application has been sent to t...

All goes down to how you pay tax. if the tax is deducted by the employer, its permanent and if you do as part of self employment, its temporary.

Re: Currently applying for spouse visa extension but run into a problem please help!!!!!

I don't see any problem if your current salary for last 5 months fulfills the financial requirement criteria. Six months payslips are only to show consistency in the earnings but if you can fulfill that requirement in 3 months payslips then it's no big deal.

Re: UK Spouse Visa- what category do I apply under?

Yes, its Category A. Yes, tell them the change in the circumstances. They look for any decrease in income if someone has changed the job but in your case, it's increase in salary so no issues.

This is my personal advice based on experience and I am not qualified as immigration lawyer.
