Re: Visa free travel for Residence Card holder Case refer to

Yes I am a British national and was exercising Free Movement Rights in another EU Member State. I lived and worked there for nearly 5 months. Then I decided to apply for Family Permit for UK for my dependent (elderly and frail) mother. It was rejected for a host of reasons, starting with her previo...

Re: Visa free travel for Residence Card holder Case refer to

Hi , From your post I can understand that you are an Australian Citizen. But may I ask what is the nationality of your partner. I am asking this coz, I am a British and my wife is Indian and we are being in Germany for the past 6 months and she is holding a Residence card of a family member of EU Ci...

Re: Visa free travel for Residence Card holder Case refer to

Were they unaware of 11(4) and 13 too? Based on my two experiences, once in Calais and second time in Luton, UKBA did not land me based on 11(4) and 13..... As I mentioned in my comprehensive post, one would be admitted to the UK without any hassle if is an EU national or is in possession of a resi...

Re: Visa free travel for Residence Card holder Case refer to

Were you moving to the UK to live? If not, why did you bother with the EEA FP instead of entering on the strength of your passport? If you WERE moving to the UK, then you ought to have demanded that you be admitted under EEA family rules. But, I can understand if you didn't want to bother with it. ...

Re: Visa free travel for Residence Card holder Case refer to

My partner and I arrived in Luton Airport in the UK on 20th April 2015. We proceeded to the passport control gates assigned to the EEA and EU citizens. There I presented my residence card which is issued in Germany under article 10 of the Directive 2004/38 and my passport. I was denied the right to ...

EC's Reasoned Opinion to the UK dated 26 April 2012

Dear All, I was interested to see the result of the EC reasoned Opinion regarding transposing 2004/38/EC into the UK's national Legislation. Time was due on 26 June 2012, however, there was no news. I contacted the EC by phone and email on 2 July. Today I have received an email regarding the result....

Their website even states that spouses of EU Member States do not need an appointment and that they can just come to the embassy Monday to Thursday between 8:30am and 9:30am - lies. Security guard will not even let them near the gate, without evidence that an appointment has been set up. I cannot b...

This is a very difficult problem, and somehow it is very hard to get help from the EC and Solvit. I would suggest a multi pronged attack. Often embassies and support organizations like GERRYs hire local staff to do a lot of the client facing work. They are very good at pushing back and giving a har...

Re: Outrageous rejection letters for EEA Family Permit?

I am looking to collect EEA FP rejection letters issued by UKBA which are written in a way that very clearly violate UK and EU law. I already have enough to complain to the European Commission, but want to gather more examples which clearly document that this is a systematic problem and is not a on...
