Seems it all depends on the current COS. If it was given post 2011 (which it is in your brother's case), then he won't be exempt. He entered on Tier 2 visa before April 2011 and new rule is applicable on those who got tier 2 after april 2011. Correct me if i am wrong.

If he was on new rule he hadnt been able to switch his employment after his recent ILR refusal as he had already spent 6 years.

Thanks mate. Thats what i was thinking too.

I dont have problem with self emplyment evidences as I got her initial visa on it. Its just that I had to off work for couple of months and my profit dropped.

We dont know much it is straight forward except one curtailment that he had. That was due to revoked licence but he went to appeal and won it.

The caseworker at premium service did enquire that if he is paid 30k/year. On that he showed payslips and bank statments. Nothing else was asked.

We are more concerned about ILR than his JR. What would be status of his ILR application as at the time of application the empolyer had valid licence but after 2 monhts its been revoked. And my brother is still waiting for his decison for the ILR premium application.
