TIER 2 ILR Salary Confusion

Dear Members, I wonder if any one is aware of the following: If the applicant is exempted from £35k salary due to part of leave being from the COS issued before 2011 rule, which salary must he satisfy to get ILR. The application has throughout been on NQF LEVEL 3, 5434 SOC CHEF since Dec 2009 and pa...

I asked about cos but ahe said that becomes irrelavant as ...

Re: Is the Tier 2 Applicant exempted from 35K rule?

Seems it all depends on the current COS. If it was given post 2011 (which it is in your brother's case), then he won't be exempt. See here: http://screencast.com/t/Wky8TABiFzwD This might be of importance: Shortage Occupations If the migrant is currently sponsored in a shortage occupation role they...

Re: Is the Tier 2 Applicant exempted from 35K rule?

He entered on Tier 2 visa before April 2011 and new rule is applicable on those who got tier 2 after april 2011. Correct me if i am wrong.

If he was on new rule he hadnt been able to switch his employment after his recent ILR refusal as he had already spent 6 years.

Re: Tier 2 ILR and Revoked Licence - URGENT HELP PLS

We dont know much it is straight forward except one curtailment that he had. That was due to revoked licence but he went to appeal and won it.

The caseworker at premium service did enquire that if he is paid 30k/year. On that he showed payslips and bank statments. Nothing else was asked.

Re: Tier 2 ILR and Revoked Licence - URGENT HELP PLS

We are more concerned about ILR than his JR. What would be status of his ILR application as at the time of application the empolyer had valid licence but after 2 monhts its been revoked. And my brother is still waiting for his decison for the ILR premium application.
