Got my passport back yesterday early in the morning before I left for work! That is just a week since I sent it back for the stamp, and exactly a month since my application was initially rejected. I thank you all for the advice and references you gave me during the most trying time. NOG, Loveislove...

What do you think about this example from the UKBA guidelines regarding ILR? Example 1 A person has leave in the UK that expires on 15 September 2008. The person departs the UK before their leave expired on 10 September 2008. Whilst the person is abroad, they obtain fresh entry clearance and re-ent...

An out-of-time application is one that is made after existing visa has expired regardless of the applicant's location at the time of visa expiration. An applicant can apply for visa extension or a new visa category either in the UK or outside the UK. Incidentally, the term "continuous lawful" means ...

That is an option too. Let me see what I can do come Monday I'm afraid it's a tough call for a solicitor to overturn the decision. The reason behind the refusal adheres to the letter of the law: "you did not have any lawful leave between 30th June and 26th September 2005". Reason no. 1: Application...

Sasikumar, Returning to the UK shouldn't be a problem. However, I have witnessed cases where the border control officers treat returnees whose visas are close to expiration with suspicion—potential overstayers. They are then refused entry to the UK. My advice is, travel if there is a dire need to. I...

The claims of your informant are at best specious. Your gap of broken continuous residence is less than 10 days, and your conviction is spent. Every case is judged by its own merits. In your case your historical conduct in the UK would be considered. Still, your gap and spent conviction are grounds ...

Re: ILR application refused due to initial stay in Isle of M

I don't think that Administrative misjudgement/error are reasons for revocation . it absolutely can't be revoked due to 'administrative misjudgement'. Administrative misjudgement describes visa decisions that are made in error by caseworkers. For instance, granting a three-year leave to remain when...
