That case was decided by the EFTA Court who's judgments are not binding on the UK as we are a full member of the EU. It is like any other court which has to take account of CJEU case law. Assuming you are working?? There was a bit of a rule change late last year re SS route.
This is not correct. Please refer us to EEA regulations overturning Eind case law.

Surely the employer can just ring Home Office and get employee status confirmed? Not having a RC is not, as far as we've been told on these forums, a requirement to be able to work.

The lack of any reply leads me to think more about the problem. We were taught in evaluating a legal agreement, that the worst thing one could do was to change a few lines here, rephrase a sentence there, and so on....because it would create a legal mess as everything in a well put together agreemen...

We were on a slightly different trajectory Piet, and we played it safe by not going out the country until RC received......BUT.....in your case the COA (you receive a couple of weeks after RC application sent) would surely do the job.
