Re: ** Divorce ** exercise access rights to a child resident

Not an expert in your situation but if you have further leave to remain as a spouse , you do not have access to public funds. I assume with discretionary leave extension this might be different, I don't know. As a spouse you can apply for ILR after 5 years but as a non-spouse would have to continue ...

Re: Dutch embassy refused visa

The link suggests that it might be necessary to get the permission of the person at the end of the phone before releasing the recording. As I read it you don't need to let anyone know they are being recorded. My suggestion is that you send a transcript of the conversation (word for word) but make it...

Re: want to work in the uk legally.

Sounds to me that you need to apply for a marriage visit visa. Arrangements can be made in advance to book an interview with the registrar but with improved communication between the Registrars and the Border Force, it is quite possible that you might be bundled onto the next plane home as you admit...

Re: Family visitor visa-refused based on the doc that was gi

There is no formal right of appeal (or very limited ones) but you can write or email them to point out the mistake. There is no guarantee that the decision would be corrected. The alternative would be to reapply bringing particular attention to the relevant document. Nothing wrong with suggesting it...

Re: is Temporary admission considered as legal stay in uk

To the best of my knowledge an IS96 allows someone to legally stay in the UK but is only an alternative to detention. It does not mean that the person has legally entered the UK but is in a state of 'limbo. My wife and stepdaughter were issued with them when they visited using the remains of the mar...

Re: want to work in the uk legally.

Thanks a lot for your reply! I am just not sure how I am going to be able to prove later when applying for a settlement visa, let's say after a year or two, that it was all unplanned. Do you know of anyone getting away like that? I would be too happy to go there in few weeks and get married legally...

Re: Dutch embassy refused visa

I would still check with another EU country, France would be logical as it is very easy to travel to the Netherlands from there. If another country accepts the travel document enter that country and move on to where you want to be. The rules state either apply in the country of entry or the one wher...

Re: Dutch embassy refused visa

Under EU freedom of movement rules a spouse does not actually need a visa if travelling with or to an EU citizen. The problems arise when he or she tries to board a plane, ferry or train. Have you tried contacting airlines etc to see if they will accept the travel document? You will have to be prepa...

Reapply but only if you can cover the original points that led to the initial refusal. Make sure the application is complete as the new application will be stand alone!

Re: want to work in the uk legally.

When my wife applied for one, it was the same cost as a standard visit visa. This thread has gone round in circles so I reiterate for the benefit of the OP, there are no short cuts, no converting visit visas in country, no way round the income requirements nor ways round the cost of a settlement vis...

Re: want to work in the uk legally.

There is one other possibility but it will not allow you to work. You are able to visit the UK (not work) on a visit visa (or visa waiver) and if you then decide you wish to marry during the visit this is now acceptable. It will not change the fact that you are still on a visit visa and would not be...

Re: Family Visit Visa for Husband

As long as your husband qualifies for a visa and can demonstrate it clearly in the application then he will be issued with a visa. If the visa is for a genuine reason, is affordable and there are good reasons to return before the visa runs out then there is no reason at all for a refusal. It is poss...

Re: Help needed regarding visitor visa

Reasons to return - property ownership, employment, settled family life (can be of limited value as in many cultures it is not unusual for family members to seek employment abroad, leaving children with relatives). Not always an easy thing to demonstrate to sufficient ties to the home country. If it...

Re: Mum's general visit visa refused - Is it worth appealing

Other than the limited circumstances stated in other posts there has been no right of appeal for general visitor visas for some time. More recent changes have just brought family visas into line with general visitor visas. Pointless appealing so reapply covering the points that led to the rejection....

Re: Help needed regarding visitor visa

I suspect the biggest obstacle is persuading the Entrance Clearance Officer of reasons to return. If the sponsor is paying for the visit and can demonstrate affordability the visitors income may not be that critical. To get a visitor visa the applicant has to demonstrate to the ECO's satisfaction th...

Re: Mum's general visit visa refused - Is it worth appealing

There is no right of appeal for visit visas. Your mothers credibility will have taken a heck of a knock. A weeks visit becomes 5 months! You would need to provide a heck of a justification for the reason the visit duration changed so much. Not many visas would be issued for a 5 month stay without ex...

Re: IRL failed instead DLTR - When can I apply again?

It does state that you did not apply for exemption -

• Nationals of majority English speaking countries (Annex A).
• Those who have obtained a degree taught in English.

If either apply you are exempt from the B1 but not the LIUK requirement.

A visit visa cannot be converted to a settlement visa. The applicant must return to his or her home country to apply.

Any hint that such an attempt may be made is likely to lead to refusal of the visit visa.
