I think its Section 3 (1).

this is what I see in MN1 guide.

section 3 (5) birth abroad to parents who are British by descent but are now
living in the UK or a British overseas territory.

I'm filling my child's MN1 as well. I wrote my child's last name in 1.5 and first name in 1.6.

As there are no strict rules for Employment status compared to ILR and Tier1 applications, we should not be worried about this. but still as any one else, I want to give them the right information.
