Approved after a long wait

We received a news today from solicitor that my parents application been approved.

We have waited over 14 months. We are happy that the wait is worth. It is a great news for us.

The solicitors also mentioned that 90% of all the rest of the applicant were above 65 and did not have to meet the exceptional compassionate test, but still got refused with no right of appeal. I thought applications under 317 had right of appeal. Any reason why they were not given right of appeal....

You may mention in your letter to UKBA that you will be initiating Pre-Action Protocol to take them to court if you don't hear from them in 20 days time. It would be easier to obtain the said information through Freedom of Information either by direct email or through www.whatdotheyknow.com

If it was under old rules (before 9th July 2012) I think you can win the appeal.

Would you mind posting your timeline, i.e. application date, biometric date and decision date.

I don't think anyone will give your their details. Your best bet is to request the said information from UKBA under Freedom of Information Act. That would give you what you need. But then UKBA will argue that each case is different and can not be compared with others even if it is similar/harder/eas...

Thanks for the info. I think we posted the application on 5th. It took over 4 months for biometric letter to be sent. Done bio in early December and no news after.

When did the other applicant done biometrics.

Hi Keisha,

Did your parents apply under old rules (pre July 9th 2012) or under new rules. Either case there is no fast track and this is one of the complex category.

We made an application and been waiting for nearly 10 months now.
