Re: EC Spouse when visiting 3rd country

I understand your confusion. The primary goal is to visit Portugal and Italy to see a family member in Italy. In this scenario, if an Indian person wishes to visit Portugal and Italy, they typically need to apply for a Schengen visa. To clarify the situation: The intention is to visit Portugal and ...

Re: Type C Single Entry: From period of validity or date of issue?

Hi! There is a part on the visa that specifies the validity of the visa. From XX date until YY date. Your focus should be on YY date. In your case, since you are still outside Schengen area, as long as this date has not passed - your visa is valid. Unless there are other unknown mitigating circumsta...

However, it is noted that the signature of the bride on the marriage certificate does not match the signature in your passport. While it is noted that you have provided an affidavit stating that the person who signed the marriage certificate and you, are one and the same, you have provided no evide...

Re: Austrian schengen visa

Hi, Currently there are worries that Europe is experiencing a new wave of Covid-19 infections. in view of that I think many countries will definitely continue to restrict entrance to citizens that are not on 'safe list'. Austria, in particular, allows entrance to some of the EU/EEA citizens albeit w...

Re: New Ruling on Directive 2004/38/EC for Third-Country Nationals of EU Family Members Having Permanent Residence

I have always harbored similar sentiments as to why EU permanent residents should require a Schengen visa to visit other EU countries (well, those who do not reside in Schengen area). However, having some experience with airlines, even if this ruling passes, it will take them 15 years to stop bullyi...

New Ruling on Directive 2004/38/EC for Third-Country Nationals of EU Family Members Having Permanent Residence

First off, Moderators: I am not sure if this has been posted here already. If so, apologies and I will delete it. Here is the new ruling in context: On June 18, 2020, The European Court of Justice ruled that family members of EU citizens who are not EU nationals themselves but have permanent residen...

Re: Can I continue stay in Greece longer than the Schengen 90 days in 180?

Hi, There are almost three laws/policies that are at play with your case: 1. Schengen policies 2. EU/EEA laws 3. National laws of Greece. Usually since Greece is also a member of Schengen area, there are some overlapping regulations. As far as I know since you have lived together with your partner (...

Hi, Even though you are a family member, the definition of EU/EEA citizen's family member(s) is a bit complicated. Family members are: 1.Spouse/partner/common law spouse 2.The direct descendants (...

Re: Can I continue stay in Greece longer than the Schengen 90 days in 180?

Basically they wouldn't give me a schengen Visa extension (as allowed for during the pandemic) because it was unnecessary due to my UK long term visa. Their interpretation is that I'm here not on a schengen visa at all, but here with the same rights of a UK citizen because I have long term stay Vis...

Hi, Technically, she can stay out of USA for one year and still keep her residency. However, there is a possibility of questioning but in most cases, being a spouse of a US citizen, she will be allowed entry. Given what is happening now, the border officers will definitely waive questioning. If you ...

Yes! Now is a good time. From February 2, 2020 Schengen visas can be applied as early as 6 months prior to travel. And as previous comments above, the paperwork is simple indeed for family members of EU/EEA citizens [these rules still apply to UK until the last day of 2020]

To obtain Portuguese citizenship from your father requires your US birth certificate, assuming you were born in the US, and parent's marriage certificate, and the details are simply copied from those certificates into a Portuguese birth certificate. So I reckon that means that your original US birt...

Hi! As long as you have a valid Schengen visa, you can enter any Schengen State regardless of which state issued you the visa in the first place. Case in point: A number of years ago, I was issued a 90 days multiple entry Schengen visa by France. However I visited Greece and Italy only due to change...
