Re: ESTA Application with previous visa approvals

@Cf_firefly Basically it'll ask you whether you have been refused a visa previously+ - 7) HAVE YOU EVER BEEN DENIED A U.S. VISA YOU APPLIED FOR WITH YOUR CURRENT OR PREVIOUS PASSPORT, OR HAVE YOU EVER BEEN REFUSED ADMISSION TO THE UNITED STATES OR WITHDRAWN YOUR APPLICATION FOR ADMISSION AT A U.S. P...

Re: ESTA Application with previous visa approvals

@max307 - Thanks for your advice/suggestions. Just in case if it helps someone else in a similar situation, I booked the flights directly to US (destination airport) and I had no problems at immigration there. I believe as long as you answer Yes to the visa refusals question, are honest on your ESTA...

Re: ESTA Application with previous visa approvals

Thanks max307, this makes sense. I haven't booked my flights yet, I was about to do that as my travel is for work related purposes so need to confirm soon. A colleague of mine is travelling from London, so plan was to travel together. I'll check if I can fly through Dublin. If immigration is cleared...

ESTA Application with previous visa approvals

Hi guys, I'm a British citizen (previously an Indian citizen) and applied for an ESTA recently looking at some threads here to find out if I can get an approval and travel next month. The question on ESTA eligibility regarding refusals reads: 7) HAVE YOU EVER BEEN DENIED A U.S. VISA YOU APPLIED FOR ...

Re: Car allowance -reimbursement of cost no benifit from HO

Mightypower I have a company car fully expensed for both business and personal use. Both my employer and HMRC consider this to be part of my salary package/earnings and I have to pay tax on this. Say if my salary package is £36K basic + Car, then HMRC uses the actual value of the car when purchased ...

Re: Car allowance -reimbursement of cost no benifit from HO

Hi vkamath, Did you speak to your HR or accountants if they can give you a P11D copy? I believe by law all employers providing any benefit (car, fuel, health insurance etc) must provide a P11D to employees and submit the same to HMRC. But this is after the tax year usually around May / June, so it w...

Re: CAR PERK - Can it be shown as earning?

Similar case of someone who successfully got ILR showing basic salary + car benefit although the benefit wasn't not mentioned on any pay slips.

Re: Car allowance -reimbursement of cost no benifit from HO

Yea P11D should be fine, also get a letter from your employer about the benefit to be 100% safe.

Good luck with your application and please do post the outcome of your application as this will always help other people in similar situation like you.

Re: Car allowance -reimbursement of cost no benifit from HO

Yes this can be included as part of your earnings. I received my Tier 1 extension successfully by showing basic salary + car benefit. And I also know other people who have done so for their ILR application too. Supporting documents I sent for previous earnings - - Payslips & bank statements - Employ...

airf1652, Submitting P11D is your employers job, and this is only done after the end of year usually in May/June before the deadline. However the first month when you got the company car you or your employer should have notified HMRC about the taxable benefit. And they would have issued you a revise...

arif1652, I totally agree with HSK Accountancy Services, car benefit is a taxable benefit and should be considered by HO. I got my tier 1 extension last month and all points were awarded for previous earnings which included 8.5k for P11D (car & fuel) benefits. Your issue could be that HMRC didn't ha...

Thanks Karg_g. Like I mentioned before, the accountants and HMRC were very clear on this i.e. earnings include anything you pay tax on in my case company car and fuel. I believe all taxable benefits i.e. car, accomodation, health insurance etc given by your employer on which you pay tax are counted ...

Thanks bubin123. Really appreciate your replies. If cases are considered only after biometrics then it should work in my favour. I will post the docs on Tuesday via special delivery. I have already sent my application and received an acknowledgment letter. So I cannot do anything now, except send the evidence that I should have sent in...

The rule you have mentioned applies to allowances where they want to be sure that its not reimbursements. Benefits in kind are not allowances i.e. 'they are not in form of money or of direct cash value' which is why they will not be mentioned on payslips and not transferred to bank account. Instead ...

Hi bubin123 Thanks for your reply. I have included the bank statements but they will not have these. Benefits are only reported through P11D end of the year and not paid through salary so wont show up on pay slips either, even though it is part of salary and i pay tax on the whole amount. HMRC have ...

Thanks for your reply, it is indeed of great help. For your appeal you did use BIK to prove that you meet the earnings required. So basically that means that if we just send payslips and bank statements without anything to back up BIK, UKBA will simply ignore it. Yes I received 2 tax code letters th...

Jay09, I thought you never used BIK for your previous applications? Or did you use it when you had to appeal against the decision for your LTR in 2009? If you don't mind me asking, was the first decision on your application related to BIK or any allowances that UKBA did not accept initially? The acc...
