Re: Thank You Forum !

Thank you, John. For the record, I should add that although I was in receipt of HB and CTB for quite some time during the spouse visa probationary period, I was not in receipt of these benefits at the time of applying for the ILR after my income rose enough to mean we no longer needed nor were entit...

Thank You Forum !

Dear John and Amber, I have written quite extensively on a couple or more threads here in the Claiming Benefits section requesting help and advice on how to approach the ILR visa when I - as my wife's sponsor - have claimed, for an extensive time during the two year probationary period, HB and CTB a...

Hi John, Thanks for that confirmation my friend. Yes as of this time, we don't have children. I don't know why I did not know about this in all my time on this board - all I read was that the foreign spouse would go on the WTC application - maybe I just assumed that with the spouse included, the cou...

Universal Credit will start to take new claims from unemployed people in October 2013. For people in work this process will begin in April 2014. The remainder of current claims will be moved to Universal Credit from 2014, with the process being complete by 2017. http://www.dwp.gov.uk/docs/universal-...

To anyone following this, Below is the latest communication in the matter to Carlisle City Council in reply to thier letter to my MP's letter on my behalf. If it does turn out that UKBA rule the HB/CTB is an increase in public funds, I will attempt to repay just the increase but am prepared to repay...

Yes I too have had similar advice. Generally speaking, it seems advice given by sources on the benefits side contradicts advice given by sources on the immigration side. Those on the benefits side, such as benefits advisors and the Child Poverty Action Group (CPAG), say HB should not be claimed at a...

Hi SoHopeful, Thank you for your helpful response esp when the member is now banned! For HB you would have to make a joint claim. If your spouse is unemployed nothing will change. If they are employed their income will be taken into consideration. I agree with you spousal income and savings are take...

Hi there Tara, Just wondering what the outcome was of your case? Did the council allow you to repay the CT discount? Did the council not insist that you should have also been paid the couple rate of HB? In my case, the council is insisting I make a joint claim for HB which would mean an increase in ...

ARE COUNCILS ALLOWED LEGALLY TO ACCEPT PARTIAL HB REPAYMENT?

Anyone think it would be LEGALLY POSSIBLE to repay back the extra portion of HB (partners applicable amount) as a result of my spouse being on the HB claim, which my local council are insisting on including? They are insisting that they are legally bound to include a partner with no recourse to publ...

Thank you Luca. Our situation is complex. I am receipt of WTC which enables me to leave the country for up to 8 weeks at a time without breaking the rules for that benefit - ie for WTC purposes I would still be regarded as resident in the UK. The idea would be to try to get some kind of IT work over...

Length of time sponsoring UK national can be abroad for ILR?

Are there any restrictions on the length of time the sponsoring UK national can be outside of the country during the probationary period before applying for ILR (inside the country)? It just seems to say husband or wife IS currently living and settled in the UK. If I were to leave the country for sa...

Frustrating that some councils are prepared to adopt a more pragmatic approach and, in the view of my replyer, operate outside the law... Actually that reply is from the councils benefit advice centre rather than the benefit issuing office itself and, I wonder whether there's any chance my council w...

If you read the post carefully u would see that HB should be claimed for u only in ur name and not with spouse on the claim so that u don't get more money as a result of her being included... to be honest I can't understand how something of such critical importance and urgency as u claim has not bee...
