No Casa, I meant, the test were taken at a test centre by herself.

She passed the whole thing in 4th attempt.

We went to the one day service.

The case handler told us that, they were informed by the ETS that the test were taken by a proxy test taker.

I don't know what proof they have.

Hi,

My wife's visa got refused, on the basis that she had used Toeic certificate in the past. They are saying it was obtained fraudulent.

We have been given 14 days to do a country appeal. Please help.

I was confused as it states.

"You are making a first application from within the UK but have not previously had leave to enter/remain as a partner."

But is her current visa not considered as enter as a partner.

I could not find any answer. Please help.

My status : ILR on 10 years basis
My wife's status: T1 dependent, expiring in May

The form is for FLR (M).

Could you please advice on the latest form, what should be ticked and filled on Section 2.2 and 2.3.

Hi,

You can avoid all the hassle and just book for A1 English test with HO certified institution. You'll get the certificate within a week. And it cost around £150.00 only.

I would suggest that once 10 years of legal stay has been completed withdraw the application and go for the ilr.

If he meets the criteria for dependent of a settled person then he can apply same time along with your application provided if you get your ILR they might grant him the visa as well.

ILR application does not allow dependents to be included.

Hi Pop,

As I see you made a valid application in April 2009 but were refused but were granted a visa Jan 2010 for same category.

Now the question is did you had a legal right to stay in the county during that period?

I'm not an expert but if your stay was legal than you should qualify to apply.

If you are eligible for 10 years ILR then go for it. Always remember immigration rules keeps on changing so always grab it if you are ready for it.

While you were on Tier 2 are all your taxes in order. They might ask you about it and to prove you have cleared all the taxes with HMRC.
