For clarification purposes, we married outside the UK and she came here as my wife (on spouse dependent visa - based on my work permit). She is officialy my wife - i.e on her passport. Thanks for all the advice, I appreciate it. When you petition for divorce, use your address as her address, the Di...

If that's what you've got, then it's got to do. The evidence needs to tip the balance of probabilities, it does not need to be exhaustively irrefutable. Other ideas might be... Was your partner on the Electoral Rolls at either address? Any evidence that you paid council tax at either address? Old ph...

In my own view, there's some substantial information missing here. Of course others may have a different view. Based upon what you've said here, you were refused a marriage visa which was upheld in appeal, you missed a visit audit (that's bad under the circumstances), and have now engaged a solicito...

Re: Calling Kayalami again or any other offers of help.

After marriage, she'll get 2 years after which she can apply for ILR. The fact that she would have gotten her ILR in May next year had she stayed employed, will that not be taken into consideration or does the counter reset back to zero? Dan, when she gets her spousal, the clock will start ticking ...

Really? The Witness Statement contains vital clues that there was a representation made to the IND in black and white. If there are doubts the investigation should be carried out before one party accuses another. It is an obvious thing. There is even a Human Rights paragraph about fair trial, etc. ...

Have the tribunal's minutes been put on their site yet? If so, send the link. If not, we'll need to see what they said. Also, did your partner represent you alone at the tribunal?

To clarify, you will need to work not more than 20 hours per week. To go 20 hours paid and 20 hours unpaid puts you in breach.

Re: What a mess! Any advice?

Will this be a problem in the future for either of us? As I understand it, your strategy is to switch from being a student to being a dependent on an HSMP holder and to work while writing your thesis. And in pursuing this, you accepted a job before your husband's HSMP was approved. His HSMP was ref...

Ok, now that you've explained it, I can say that your refusal history is a non-event in the eyes of the Home Office. Forget about it. You've got 2 immigration strategies on the plate: spousal and hsmp. But you cannot apply for both on the same application. If you restate your question as "Will my wi...

First of all, the conviction of her parents has nothing to do with it. As long as she has a clean sheet herself on the VAF questions, she's fine. Your own refusal history may not matter too much unless the circumstances were especially dire. Your savings and earnings are not the greatest, but people...
