Re: ILR question- Yea or Nay?

My legal interpretation still remain valid 10 months down the line. Thanks Obie and Vinny. Very much appreciate your input. I do not have legal background and it seems this is too complicated for me to take the fight with the stubborn HO caseworkers, although I am convinced that my wife should have...

Re: ILR question- Yea or Nay?

Hi once again. Has the law been changed recently? Can my wife still apply for her ILR (set M) based on her situation, that she applied for flr(M) on Jan 2013 and got the dependent of settled person visa on May, 2013. I was granted ILR on 10 years rules in March 2013. Fyki, she first came to UK as st...

Re: ILR question- Yea or Nay?

Her chances are as strong as it gets. The law expressly provide that she ought to qualify. Therefore any refusal will clearly not be in accordance with the law. Few people have experience difficulties with them in that regards, but the buttom line is, the law is the law. Thanks Obie. I appreciate y...

Re: ILR question- Yea or Nay?

The leave that she was given is wholly flawed, you should fight against it. She should be able to qualify for ILR now, based on the rules in place at the time of her application. She would qualify for ILR, but the rules in place does complicates things, and you will therefore, need to fight them a ...

Re: ILR question- Yea or Nay?

When was the application for ILR made? Was it before or after may 2013? My ILR was granted on March 2013. Her FLR (M) application was made on Feb 2013, when my ILR application was being considered by the home office. Her FLR M was approved in May 2013. But as I said earlier, she was allowed in this...

ILR question- Yea or Nay?

To the great and the good of this board: My wife came to the UK on Dec 2009 as dependent spouse of a Tier (4) student. on her latest extension, she was granted 2.5 years stay as a dependent of a settled person (based on long-residence) in May 2013. As the changes made on April 2014 have proven to be...

College switch and fees issue. Urgent help needed.

Ok my niece switched her college halfway of her A level studies. She studied in the old college for a full year, paid the full yearly fee, but did not achieve satisfactory progress. She actually failed in few subjects. We paid a lot of fees to this private college in London but we were not happy wit...

I'd have thought as below. If <your first dependent visa was Issued/Applied Pre-July > then 2 yrs Qualifying Period Else 5 Yrs Qualifying Period End if If <your previous stay as dependent was not on route to settlement> then You cannot add/Combine/Amalgamate your stay. else You can add your previou...

Also, can we consider that 'partner of a relevant point-based system' in your quote also refers to 'partner of a now settled person who used to be a migrant on non-settlement route' so to speak? I still find the provisions fuzzy.

Hi all, can someone on the know elaborate on the 2/5 years qualification period for an ILR dependent, where: 1. The dependent of the current ILR resident came to the UK in Dec 2009 as the dependent ofa Tier 4 Student. 2. She got her visa extended as a PSW dependent for another 2 years. 3. She now h...

Hi all, Just to let you know that I received my BRP with ILR today. Had posted my SET O application on 05.01.2013 and got the approval on 18.03.2013. Had my biometrics done on 07.02.2013. So just about 10 weeks all in all. No lawyer involved. I had been a silent reader of this forum and want to say...

Help with form-ILR applicant's dependent applying with FLR-M

Hi, My wife's dependent visa expires in early February, as does mine. I am applying for ILR via long residency route. On page 9 of FLR (M), there is a rather tricky question (sec 3.15): If your sponsor was not British from birth, when did your sponsor obtain settlement? As I am yet to obtain settlem...

ILR applicant, dependents and finances

Hi Few questions about ILR (10 years residency route): 1.What form is required for the dependent of an ILR applicant applying at the same time as the main applicant? 2.What are the financial requirements for the ILR applicant's partner? And plus a child? 3. Is it OK to apply for our baby (born and l...
