I think in such cases UKBA should still be bound by the six month rule as after withdrawal of their decision one can argue that no decision has effectively been issued. We are both in UK. My partner's previous tier 1 visa was coming to an end but we were planning on getting married so did not think about it. We then had to postpone our wedding due to a few deaths in the family hence applied for EEA2.

We are in a similar situation. My partner applied for EEA2 before his previous visa expired and his COA stated that HO could not determine his right to work at this stage.

I still believe that Section 3C applies as EU citizen cannot be given less rights than those applying under immigration act.

We have not sent the pre action letter yet. Wanted to get some other people views as to what we can expect before we go down the route.

I think irrationality will be one of the grounds.
