Hi, I'm no expert but have some experience in this. I think you are right to be worried about him not being able to get back if he left for his motherland. There is a good chance he will not be allowed even a visit visa for a while. As you 2 are not married and can not prove that you have lived tog...

Hey, Well, I think it really depends what you want to do. If the regularisation of his status is not urgent and you both do not plan to travel outside the UK, etc.. and happy to wait a few years for the outcome of the case, this is probably one way to go. However, if he wants to have his status sort...

They do not give priorities to the lost cases.
You need to chase this with the POU (details are on the notice of the AIT hearing). If this does not help, write to the Appeals Directorate customer service.
However, give at least 4 weeks after the determination date before chasing.

Re: APPEAL ALLOWED

I really thank you so much, it seems to me that you have worked for this organisation before or still currently working for them, i would not go any further no more... No worries, mate. :D No, I have not worked for them, as I have never been a British citizen :) In fact, I will soon be Australian. ...

Re: APPEAL ALLOWED

Do you have this AIU contact telephone numbers as well, please There are telephone numbers but all of them are confidential and mainly intended for the use by the BA staff. The telephone numbers are the last resort only. You need to write and put your concerns in writing to them. You will then get ...

Re: APPEAL ALLOWED

do you think AIT has got seldom for late counter appeals made by the POU? because at the moment the counter appeals time scale lapsed. Appeal outcomes (allowed ones) are reviewed by a special division called ORAT (don't ask me what it stands for because I do not know) at Presenting Officers Unit in...

No, you do not contact AIU until you are sure that your file has been sent to them - they won't help you. You need to contact your POU and if they have sent your file for implementation, then you contact AIU: Appeal Implementation Unit Ground Floor Waterside House 471 Kirkstall Road Leeds LS4 2QB Go...

Well, it is not about a request, mate. If you have won an appeal and BA did not launch the counter-appeal, the BA "must" issue you with an extension so you have the right to demand it from them. I suggest you contact your Presenting Officers Unit and find out what is happening. If you do not get a s...

Just call the AIT customer service and find out if the counter-appeal has been lodged by BA. If not, wait 2-3 weeks and if not heard anything, call the POU and find out where your file is. Normally if they decide not to appeal, they would send it to the AIU for processing, who will be in touch to re...

1. Confirm with the AIT that the UKBA has not launched an appeal (ring the AIT customer service number and give your appeal reference number) 2. If not, contact your POU and find out why it is taking so long and ask whether your file has been sent to the AIU. As soon as your file reaches the AIU, yo...

I am not familiar with the latest caselaw but I had a somewhat similar case to yours. My documents were also lost and while they were messing about with my case, I met someone, married my wife and we had a child although my wife was not a British Citizen. I won my case eventually (even though I left...

The starting point will be reading the rules about the 10 year residence requirement and the associated policies from the UKBA website and make relevant notes on the sheet of paper, whichever applies. Those will help you understand if the UKBA's decision was or was not in accordance with the law. Th...

I'm an Australian who's made his home in the UK and I do feel duty bound to point out that Australia was the country that implemented 'the Pacific Solution' in relation to at least a certain class of migrants . . . and a number of other rather nasty policies which are not so well known, including m...

Well, we live on AU$200000 a year, which is around GBP90000. After 1.5 since moving from the UK, we have three houses, although single storey ones, but all detached (all houses here except some townhouses in big towns are detached and not like those in the UK similar to the army's barracks) in good ...

I absolutely agree with Kpax. The UK cannot be compared to Australia in any way. I had lived in the UK for 9 years and every year the quality of living had been deteriorating and everything around was getting worse. Now that the UK is in recession (something that was expected) we are happy that we h...

Clearly this is a matter of complaint (NOT an appeal). You should write a complaint to the ECM, if not, then you should contact the complaints section either at FCO (if the UK Visas still comes under the FCO authority) or at the UK Border Agency in the UK (if it is not) - I am not quite sure, as the...
