Re: "genuine and effective" residence w/x-border element

This is a really interesting case! "It would be clearcut if the worker was not working in their home country but was transferring between two third-party memberstates." what I'm wondering is if the nationality of OP's wife was different. Hypothetically speaking what if the circumstances were the sam...

Norway, Surinder Singh, family immigration rejection

I'm currently waiting on an appeal from Norwegian immigration and was hoping I could suss out some advice from the collective experience of these forums. TL;DR: I'm pretty sure Norway is breaking EEA law/obligations under the Directive by rejecting our application for family immigration pursuant to ...

Re: How easily can a Non EU citizen emigrate to Norway?

You can find all this information on the Norwegian immigration page UDI . Generally speaking, the answer to your question greatly depends on 1. the country you are from (EEA vs. Non-EEA), 2. which immigration application you are applying from (ie: family immigration, student visa, etc..). Once you h...

Re: Sweden denied visa to non-EU family members.

That sounds like good news if they're sending it back to the embassy. Hopefully with them kicking it back to the embassy, maybe they'll get it right this time. Good luck!

Re: Residence permit - Norway

If the residence permit was granted in Nov. 2013, then it should be good for a year; however, I believe you have to notify UDI if your status changes (I cannot confirm this). That being said, liksah is right, if the child was born in Norway, and thus has Norwegian citizenship, then that child can ac...

Re: Sweden denied visa to non-EU family members.

I normally wouldn't agree with the my suggestion either (since the directive is very clear, as you say); it's a quick solution to a current problem (if time is important) and offering up tickets now doesn't mean that they cannot challenge or contest this rejection later. It won't affect their visa a...

Re: Sweden denied visa to non-EU family members.

Sorry about this situation. SOLVIT was of very little help to me as Migrationsverket was steadfast on their decision, even though they had broken a few EU laws in the rejection. I wish you the best of luck. Obviously you have a case since Article 5.2 and 5.4 of the Directive cover this explicitly. W...

Re: Non-EU spouse residence for EEA family permit

You should be okay with your civil partnership since Czech republic acknowledges/allows registered partnership as of 2006 and the Directive stipulates that "family" should extend to your registered partnership so long as the Host member state acknowledges these. Hopefully the embassy will confirm th...

Yes, both must be covered by CSI and, as my current issue is teaching me, you should find out exactly what CSI is from the German authority because there is no European precedent for this, thus every country will have different definitions of what is "comprehensive" (in my case, which is in Sweden, ...

We did end up contacting SOLVIT who, in turn, contacted the Swedish migration board. The response we got was that there is a difference between residence card and residence permit and for an RC they take into account income and health insurance and that we should re-apply for a R.P instead of R.C (a...

To confirm: Free Movement blog highlights relevant information for travelling without a visa. It is possible to travel without one, but is always easier with one. After the first three months your friend would need to register as living in Spain and exercising his right to free movement. At the same...

We finally got in contact with our case worker, but she seemed mostly uninterested in listening to us and stuck with the decision and the reasoning behind it. She did agree that we were meeting financial obligations for free movement, but got stuck on the health insurance. She even stated that it's ...

Residence card rejection, EU law, and Sweden

I am seeking some advice from the experience of Immigration Boards. I apologize for the length. I am a Canadian citizen married to a Norwegian citizen; my wife is exercising her freedom of movement treaty rights (Directive 2004/38/EC) by residing in Sweden, but working in Norway (self-sufficient) wh...

All went well in my travel. The passport control officer had no issues letting me in. It went something like this: PCO: Where are you going? Me: Sweden PCO: What is the purpose of your trip? Me: I'm joining my Norwegian wife in Sweden PCO: How long are you staying? (looks at all the stamps in my pas...

I've been re-reading the directive and MRAX vs. KofB just to prepare myself. I'm transiting through Iceland (unfortunately there's no direct flights from Toronto to Stockholm) and I'm slightly nervous about entering Schengen there. I know the laws and I know (now) that the 90 days shouldn't matter, ...

As far as I know, you cannot claim Dutch citizenship based on where your ancestry line originated from. It is only through your parents. One or both of your parents must be a Dutch citizen. Every child who is born to a married Dutch father or mother automatically acquires Dutch nationality at birth,...

Moving with EEA-resident question

I know I posted this in another spot, but I'm seeking an answer and I'm not sure if people can see it where I posted it. I'm also sorry if this has been covered somewhere else; however, I didn't see anything. I am a Canadian citizen married to a Norwegian citizen who is moving to Sweden in less than...

I am in the process of trying to join her in Sweden, however, I have a q...
