You can apply for your son without any co -habation documents.

Can you list out out what all documents you have with your wife name?
Council tax?rent agreement? or any other bills which has her name?
Registered with GP? Driving License? visa extension letters from Home office?Bank accounts?

There is no need to medical certificate, if you have any other supporting documents thats fine for example hospital report or birth certificate of kid will suffice , these are required only if they ask. most of times they will not question. co-hab documents which i have taken/given are in the link I...

There are two option which I think are best for you:
1. Apply by Post (approval may take few months)
2. Apply for her ILR on 9th aug in PEO (you are applying within 28 days after expiry) , I am not sure whether this is right.

Solihull have now changed the process payment first and then case worker will have look in to your case.

you can do it if they are eligible and there visa does not expire soon.
Get your ILR first once you recive your BRP then apply for depdents+kids by post but note it may take 3-4 months to know the outcome.
