Re: NEW EEA Regulation that violates EU law coming into eff

I have concerns with Regulation 9(2): (2) The conditions are that— (a)BC— (i)is residing in an EEA State as a worker, self-employed person, self-sufficient person or a student, or so resided immediately before returning to the United Kingdom ; or (ii)has acquired the right of permanent residence in ...

Re: Enter via Calais

Hi ninmurai I am looking to do the same but via calais. Can you assist by answering some of the questions below: 1. Where were you exercising your EU treaty rights and for how long? 2. What documents did you bring with you? Did you have to translate them in English such as utility bills or bank sta...

We did not present a landing card! We filled one, but he let us through without us ever handing it over

Re: What does an EEA Dependant ink stamp look like?

Thanks Vinny!

Since our stamp does not mention the EEA Regulations, do I infer that we have not been admitted under such a procedure? If so that would be strange because there cannot be any doubting which type of admission we were after!

What does an EEA Dependant ink stamp look like?

Hi there, We entered the UK via Harwich International Port back in April under Surinder Singh rules (me UK national, my partner non-EEA national) without a Family Permit and using only our Article 10 Residence Card issued by another country. At the border we explicitly asked for entry under European...

Re: EEA employment status for UK Ltd. company directors?

hi it will be better to register as sole trader in the state where you want to exercise eu treaty rights so you can pay taxes in the state where you will be living to exercise treaty rights. Sole trader would not be an option in this instance - in the industry I work in (construction), it is unwise...

EEA employment status for UK Ltd. company directors?

I searched these threads a few times, but the question does not appear answered for this topic. If I become the sole director of a UK Limited Company and wish to reside in another EEA member state and run the company from there, how would this employment status be seen? I'm aware under 2004/38/EC yo...

Re: Arrived at UK for short stay, no EEA Family Permit

Be very wary how you approach this. There was a recent refusal under Surinder Singh due to the applicant's statement in the EU FP application quoting the 'SS' rules. The decision to refuse was due to the couple having prior intention of re-entering under the Surinder Singh route and thereby 'circum...

Arrived at UK for short stay, no EEA Family Permit

This post is to add a data point rather than to seek advice. I'm a UK citizen exercising EEA treaty rights in Netherlands. My Taiwanese 'registered partner', equivalent of civil partner in the UK, has an Article 10 residence card confirming her EEA rights too. We just arrived at London City Airport ...

Sorry the title of this thread is misleading as ultimately there was no 'visa' involved, only 'permits'. As a Taiwanese, she entered visa-free as a tourist (up to 90 days permitted) and then we swapped that over when we submitted the verification against 2004/38/EC. No MVV required at all. I don't u...

Approved!

Just to update that the verification with the IND for my partner was successful and we now have necessary documentation to prove that I am exercising my 2004/38/EC Treaty rights here in NL with my family member. In the end we went for a "registered partnership" under Dutch law, so that we have our r...

No, we have a combined 12-13 months or so living together, 6 months between Oct 2010-Apr 2011, and Nov 2011- Apr 2012 and July-Aug 2012. No children. Unfortunately because for each of those stays she came to UK under tourist visa, I couldn't register her residence hence we have no official documenta...

Sorry to restart this thread, but could I ask about point c) from my first post? If we are not married, what proof is possible of a "durable relationship" where we don't have official documents of living together? Put together we have more than 6 months cohabitation and can prove it through photos, ...

If you are married to your partner or have a registered civil partnership, then they can trivially come with you. Getting married now, after being together for so long, should be no problem. If the NL government later suspects a marriage of convenience, then they are allowed (at that point) to ask ...

NL res. visa for Non-EU non-married partner of EU citizen

Hello everyone, I'm new on this forum so do be gentle! Background: I'm a dual UK/Taiwan citizen and have lived in UK all my life and will move to NL in March with a confirmed job offer (working as employee) starting in March 2013. I will be moving across just a few days before starting work and regi...
