Re: ILR for spouse(Applying separately)

Hi Amber,
I m applying ILR for my Spouse and under 18 children on one SET O (Spouse main applicant and under 18 children dependents). But my spouse and children are all my dependent on me (in sense of visa/immigration). Will this be still ok to put them on on set O. Thanks

One more question,
"can under 18 children be included on the Set O form filled for Spouse of a PBS applying separately?". Thanks

Re: ILR for spouse(Applying separately)

Amber Thanks for help; Yeh this looks very complicated. So I request your advice just in my case below; I m on PBS Tier 1 Gen Nov-2008 & Dependents got visa in Nov-2009; First extension Nov-2010 and 2nd extension: March-2013 (Due to long absence in 2009); Valid til Mar-2015 Now I qualify for ILR (co...

Re: ILR for spouse(Applying separately)

Hi Amber, thanks for your response; I m interpreting 3.3(b): "If an applicant (DEPENDENTS) was granted an initial period of leave to enter or remain as a PBS dependant after 9 July 2012 but has not lived with their PBS partner for the required 5 years (but Dependents don't need full 5 years as they ...

Re: ILR for spouse(Applying separately)

Yes; 3.3 demands dependents to to apply further leave to remain under paragraph 319C (b) (iii) (1) or (2) within 28 days of ILR approval of the principal PBS immigrant if dependents cannot apply ILR because their current Leave to Remain become cancelled/invalid as visa (Leave) of their principal on ...

Re: ILR for spouse(Applying separately)

Amber thanks for correction. My 2nd extension caseworker told me that visas of my dependents stand cancelled (which were valid apparently as extension was applied before time) as their visas were dependent on my first extension which has been cancelled and replaced with 2nd. So if a principal applic...

Re: ILR for spouse(Applying separately)

Is dependents stay 28 days after you ILR LEGAL?
I understand that ILR is granted with CANCELLING the current visa; on which dependents' visa was valid and hence dependents' visa automatically stand cancelled. Am I right? Sorry if I m WRONG.

Re: Requirement for ILR Dependent

Amber thanks for correction. Yes it is Set O for PBS dependents. But if application of dependents is made after approval of ILR of principal applicant (through PEO) then Set M or even then Set O?
Also which form will be used for 18+ dependent?

Is it SET O or SET M? I think correct form for dependents is SET M.

Re: Absences Previous Employer not exist & Absences non UK p

HSPM was closed in 2009 (since July-2008); Your visa will be Tier 1 Gen definitely (no need to show economic activity etc); You looks just confused otherwise your case looks OK and you will get success.

Re: Letter form home office about absences out of uk

Hi Moon,
Sad; normally Tier 1 cases don't require to give proof/evidence for absence<180 days unless until they are due to compelling or compassionate reason. What reason did you fill in SET O forms submitted? It looks your reason demands proof.

So; is there any timelimit for children 18+ for ILR eligibility? I don't think so as they will apply as dependent still (need to prove dependent), am I right?

Re: How much time do I have to make FLR(M) for spouse

Have you renewed visa for your spouse after your ILR? If not then you should mind that dependents' visas stands cancelled soon after principal's visa is cancelled (as previous visa is cancelled before isuuing new ILR-Visa). This could be a big mistake if extenstion for dependents isn't made with 28-...

Re: 28 days and 5 years calculation

Hi, "You can apply 28 days before 30th May 2014 if your initial entry to uk was within 90 days from EC stamp date" is very CONFUSIVE statement withour any reference. 28 days before date of eligibility for ILR NEVER demand first ENTRY within 90 days. 90 days issue is ENTIRELY different to 28-days bot...

Re: Help to select right application form!

Dependents need two year resident in UK before applying ILR for Tier 1 General and I think they can apply for ILR directly after the principal has got ILR via long residence instead of Tier 1 G. Seek full advice bfore applying.

[/quote]It's not clear whether all your absences were while you were unpaid in the UK. But if they were, then reading this thread will help. It appears the UKBA are stating that any absence that was taken while unemployed in the UK would be considered a break in continuous residence. You cannot quot...
