In my opinion you were refused as you don't have a valid visa. As you have mentioned you overstayed since 2003. This was the same reason that is why your embassy refused to renew your passport. I would suggest you do it right, you need go back to your country, marry your partner and apply for FP. W...

Really? You are putting the present application at disadvantage on the foot of a potential application? The immigration application isn't to be taken lightly, by the time you get sucked in the appeal system, you will quickly appreciate the need to get things done better.

Barring oversight??? What does it mean?? Why no right of appeal?? Except is there were to be some mistake by the caseworker, taking into account that they have not been able to confirm your identity, you will not be given a right of appeal. Is there a reason why you could not provide an original ID?

@ Wanderer, you do not have to agree, your disagreement does not change the legal fact, I did not pronounce the judgment, the tribunal did and therefore binding. The scenario described by you with regards Germany is distinct from discussion on this thread for which I am not prepared enlighten you on.

2 Years cohabitation is not a mandatory requirement under EU, there is no reason why the application cannot succeed, of course UKBA may assert marriage of convenience, which is entirely not relevant at the moment, but definitely EU law does not make a mandatory requirement of 2 years cohabitation. ...

If the UKVI cannot identify you, how do you expect them to consider your application? Did you provide any other identification document? You are unlikely to get a right of appeal with any refusal decision.

I think people are unconsciously using a very derogatory term to describe a person's situation, even in practical terms it isn't right as human being cannot be illegal? Undocumented, clandenstine are much more appropriate, although I note that chaoclive has only quoted the previous poster.

Get married and continue with your appeal, you risk wasting another 6 months and another refusal with another application. It is very unlikely that you other half would succeed without the help of the judiciary, so stick with it.

EU national without PR, even Non-EU family member with just a residence card have far more enforceable right than someone with ILR. Its no brainer that one.

You will be admitted if you manage to get to the border, how you manage to do that I don't know. But you should have no problem entering the UK.
