Re: British Passport application processing timelines (only)

I am talking sense. Most British people are against massive immigration, and that is a fact. If you have a problem with this then it's not my fault. Bringing/ breeding a foreign tribe in this country is something that is bound to be frowned upon. The only one who is embarassing himself is the guy wh...

Re: British Passport application processing timelines (only)

Well, I got my citizenship (and passport) for myself. I didn't bring a tribe over here, nor did I breed one (5 people!). While this forum is for immigrants, most of them are INDIVIDUAL immigrants, NOT TRIBES like yours! No wonder why British people have turned against -massive- immigration.

I'm an EU national so didn't have to apply for indefinite leave to remain

You need to apply for PR (Permanent Residency) as I did. When you get that then you can apply for citizenship.

Re: Unsuccessful applications

Sorry to hear your news. My understanding is that you only have 3 months from the decision date to then request a re-decision so you may well have missed the cut off point and so a new application might be in order. I can't comment on your case as i am no expert but would recommend using a lawyer t...

Am I missing out on some information I should know? Also where can I find a reliable legal help, please? Than...

Re: Unsuccessful applications

Finally got a reply from HO. My reconsideration has been successful after an 8-month battle. I can't believe that the HO employs such a an incompetent bunch of people (caseworkers), who don't even know the definition of a conviction/ non custodial sentence. Worse, the HO provides such a bad quality ...

Re: Unsuccessful applications

Yeah but OP has an FPN and court uplheld it so 3 years ban. Any word on your reconsideration request? PATAS is NOT a court; it's an independent civil arbitration service. Only judges can hand in custodial/ non custodial sentences after the issuing of a conviction. The latter can only be issued at t...

Re: Unsuccessful applications

That does not apply to you. If you appeal against an FPN and it is upheld, that is considered as non custodial sentence which means application will be refused for 3 years. Mine was an error of assessment. The caseworker mis-interpreted the guidelines related to pcn & fpn and the difference between...

Re: Unsuccessful applications

Thanx Jason,

I managed to get a statement from the adjudicator who issued me with a pcn stating that it was not a cnviction of any kind so hopefully reconsideration shoud be successful

jabajaw wrote:did you declare the FPN in your application?
I did

Mine was a PCN, not an FPN. The difference between the two is that the Fixed Penalty Notice (FPN) is that a FPN can lead to criminal prosecution if not paid.

Re: Unsuccessful applications

Agree. I misinterpreted Traffic Appelate Authority with Immigration Appellate Authority ...infact there is no entity as Traffic Appelate Authority ...for London parking and traffic it's PATAS. so can you post the exact reason for refusal? perhaps you can apply to reconsider the decision? It said "a...

Re: Unsuccessful applications

For your info it's called "Parking and Traffic Appeals Service" lol. Besides, this is a not a non-custodial sentence as a non-custodial sentence needs to be issued at the end of a case involving criminal proceedings. It also needs to be handed in by a judge of law, not an adjudicator in a civil trib...

Re: Unsuccessful applications

3 years from the Traffic Appelate Authority decision date so effectively 2 years from now. If it's FPN or PCN - which are not conviction - then usually multiple offerences lead to refusal. In this case it was considered as conviction not an offence. Where does it say "3 years from the Traffic Appel...

Re: Unsuccessful applications

Well, it's actually they said two years since the the penalty occured in 2013. I have gone through all the good character requirements on the HO website. My traffic "offence" does not fall under any of the four main reasons for refusal of an application based on good character requirements. It is no...
