There is nothing new in this. For many years now, for any work permit application the prospective employer has to prove that he could not fill the vacancy locally. Wonder why the government is announcing this as if this is something new they have done. Such statements create a negative generalisatio...

The transitional arrangements from HSMP to WP whereby the resident labour test is waived clearly states that one has to be over 12 months in the current job in case the previous Leave to Remain was more than 12 months. Home Office may not waive the resident labour test if you have been less than 12 ...

Even if the JR may be a "joke" at least it has an entertainment value for people not affected by retrospective changes who can laugh at it. That in itself cannot be a bad thing. The judgement will soon reveal whether the case and its accompanied statistics are valid or not so only to wait for it at ...

Thanks all for your replies. A) If you English is already at above ESOL (En...

SYH, thanks for your reply. Does this mean that for ILR passing the Life in the UK by the main applicant and the spouse is sufficient and a separate test of competancy in English is not required for ILR purpose.

Thanks for your reply. The IELTS is the test of English Language. If the dependent spouse has to sit for the Life in the UK test it obviously means that the test of English would have to be given as well. This is unecessary time and expense for both partners having to give these exams, it should be ...

Does the Dependent spouse need to pass IELTS/Life in the Uk

When the WP/HSMP Holder applies for ILR after 5 years of stay the main holder is required to give IELTS and the Life in the UK test, however the BIA website states that the dependent spouse needs to pass both these tests as well or the spouse's ILR application is rejected. Is it mandatory for the sp...

I would have left you to do your own homework but to make your search easier, look at the last post (by rg1) on page 1 of this thread Sorry if I have missed something, nowhere in the post does R...

Someone had questioned why people are going for a JR, it is being done to oppose injustice like this. It was me btw who questioned why people are going for a JR if they do not plan to settle in this country permanently... It doesn't make sense to me... I don't know if it does for you... Who told yo...

When they last made the changes in Dec 06, all the affected HSMP holders made lengthy correspondence with HO and one thing came out very clear, that the HO's understanding of restrospectiveness is very different from us. As per HO, if they allow us to complete our existing leaves without curtailing ...

These rules will affect a majority of us. Most HSMPs are at the most in the 4th year of HSMP and by the time they reach the period of five years, these rules may hit us anytime now. We have been truly duped by HO with the word "Migrant" in the HSMP thinking that we would ultimately reach some form o...

Isn't a WP holder allowed to do an additional job providing it is "part time" in nature ie 20 hours or less ? This would help the WP holders to earn a little extra income.

The JR of HSMP Forum Ltd has got permission for a full hearing as the judge as accepted that case has a prima facie merit. The hearing would come up by the next month. Thanks for your reply. My understanding was that "any change must be informed" applies only if you change an employer and not if you change a job within the same employer. I am in running for a promotion and was wondering whether the above stipulation would come in way.

WP Change of Job within company

On the WP visa it is stated that any change must be intimated to the HO. Also in the WP permission issued by HO, the designation and the salary under which the holder is employed is stated. My query is, that midway through a 5 year WP, if within the same company, the WP holder is promoted to a diffe...

Hopefully, the clock would not restart now after switching to WP from HSMP under transistional arrangements. Cases like Edelweiss are sad. In 2003-2004 Home Office catagorically promised ILR in 4 years to those who come in under HSMP and remain econmically active and not claiming public funds. Whether they failed to judge that people would do unskilled jobs to survive is primarily their error of judgement ...

Nowadays HO is just concerned in how much you earn and do not care what your profession is. You are right that many minicab drivers earn very well especially if they do odd hours, weekends etc so it may be a more lucrative profession than an office job.
