ILR approved

Hello I would just like to share with everyone that I had my ILR approved! I only found out about the rule change on 5 April, which of course instantly set me off into panic mode, as I had very little time to gather any information or evidence and was not sure if I was eligible! My situation is this...

(c) Except for periods where the applicant had leave as a Tier 1(Investor) Migrant, a Tier 1(Entrepreneur) Migrant, a Tier 1(Exceptional Talent) Migrant or a highly skilled migrant, any absences from the UK during the five years must have been for a purpose that is consistent with the applicant's ba...

[quote="arihan"]I spoke to my solicitor and he said that as its in the limit and you have not crossed taking the holiday more than permitted so no need for evidence/document as I've taken only 19 days(in 2008), 24days(in 2009), 7days ( in 2010), 27days(in 2011), 31days ( in 2012). No payslips are not a requirement, but they can demonstrate that annual leave was paid out to you. I'm going to have to go the employment contract route and personal letter and hope for the best.

This is a bit of a palava! I worked for an umbrella company and that employer stated that they would not confirm my absences from work, nor would they be able to confirm what those absences were for! They would only confirm my employment! My appointment is this Thursday and I have no idea what to do...

This may have been addressed in a different thread with reference to the following passage in the immigration rules: (c) Except for periods where the applicant had leave as a Tier 1(Investor) Migrant, a Tier 1(Entrepreneur) Migrant, a Tier 1(Exceptional Talent) Migrant or a highly skilled migrant, a...

Hello ilrapplicant I did not draw the same monthly income as I was working under an umbrella company or as a temporary worker for 3 years. So for example: I was employed by an umbrella company from April 2007 to July 2010. They essentially contracted my services out. My work assignments were short t...

People could also use their work contracts over the past five years to evidence their employment and their annual leave entitlement. Does anyone have advice for temporary workers or contractors? My situation is that I was employed under an umbrella company for 2 years and a temp worker for the same ...

Advice please - evidence for absences for ILR

I would like advice on evidencing my absences from the UK, given the change in the immigration rules. My situation is as below: I have been on the HSMP May 2008 and transitioned onto Tier 1 General visa in May 2010. I worked under an umbrella company and temporary worker for 3 1/2 years. During this...

Congratulations on your ILR!

I was just wondering what you wrote down as the reason for your long absence?

Immigration Advice given

Hello Just paid an exorbitant amount for a 30 minute consultation with an immigration advisor. Was advised that my days exceed the required amount and it is unlikely that the Immigration Officer will exercise discretion. The Advisor was adament that it is 180 days over a 5 year period, with exceptio...

Hi Rubina I have a similar work history to you with regards to being a contractor and a having a permanent post, under a Tier 1. I was wondering if you were questioned at all about unpaid absences from the country (presuming you travelled out of the uk whilst you were contracting). Can I ask how man...

Green Tea I was thinking your situation might be slightly different as I am looking to transition from a Tier 1 extension to ILR and it sounds like you are going from long term residency. I am concerned that my application will not be considered on a same day basis at the PEO. As had been advised by...

Hi Green Tea

I was wondering what you were advised with regards to allowable absences outside of the UK? As I understand it, it is 180 days per year over five years. We're you over this allowance?

Hello Thanks for your email. I was aware of the new guidance. However most of my absences were unpaid leave, which the guidance does not seem to allow for. Additionally, I have discussed this with two visa companies. One said that only 6 months (or 180 days) were allowed in a five year period and th...

ILR - absences, discretionary applications, what if declined

Hello I am looking to apply for ILR. I was granted HSMP in may 2008 and then transitioned onto a Tier 1 extension. My visa is due to expire in May 2013. My situation is slightly complicated by my absences. I have had 228 full day absences over the past five years. All of my absences have been due to...
