If i understand clearly a family member who is now divorce with PR or ROR may apply for settlement status providing he has been married for 5 years . Is that correct? Does such person also need to prove that the Eu citizen was exercising treaty rig...

[quote=CR001 post_id=1689761 time=1539003030 user_id=70994] Overstaying and working while not permitted to work due to having no legal status will go against her as she is required to provide 10 years employment information in the form. Re: Student visa refused in 2009 - application for British citizenship in 2018

Thank you for your prompt response CR001, she was indeed an overstayer and since her employee never requested an update of her residence card she kept working for about 7 months before quitting.

Re: Student visa refused in 2009 - application for British citizenship in 2018

Correction:

My advise to her is to wait until November or December 2019, because the fact that she was in the UK from November 2009 till December 2010 without a valid residence card may affect her citizenship. Am i correct?

Do not forget that your partner will need to be exercising treaty right and be resident in the UK from beginning till the end of divorce (decree absolute).

Re: EU & Brexit Deal

There's no reason why they can't use a simpler process - the qualification for PR will already have been demonstrated. The problem id whether they will be eligible. A restrictive reading suggest they are not. Under the British rules, one loses the retained right of residence once one obtains perman...

Those who already hold permanent residency documents should not have to go through the full process, for example.
Do you think that include Non EEA who retain right with PR?

Re: Residence Card-Non Eu spouse

Surely the employer can just ring Home Office and get employee status confirmed? Not having a RC is not, as far as we've been told on these forums, a requirement to be able to work. That is how it is suppose to be! Unfortunately vert cautious employer won't accept an employment without any form of ...

Re: Residence Card-Non Eu spouse

You will need to apply fast to avoid jeopardising your job. note that it may take up to 2 month for you to receive a COA which will put your employer at ease. also why don't you and your partner try and get a CSI in ordr to cover any future gap in employment?

No route unfortunately based on your status and as you are not an EU citizen but a RoR PR non-EU citizen, you cannot even use the EEA/EU route, which might have been possible had you been married to your EU ex spouse. Yes indeed!!!. what about if i acquire british citizenship, is there no way to he...

And of course she has just missed the intake for September. Also, make sure if you are going to go the student visa route that it is an HO approved university/college. Also, there is a limit of 5 years I believe that she can study. She also cannot apply for ILR/PR from a student visa. This is harsh...
