hi

there is no law which says that you have a legal right to apply in next 28 days. its just that application will be decided on merits n wont get refused straight away for being out of time. but if leave ended the day on final decision came, how psw can continue?

hi

well your appeal was not only granted on article 8 but also on article 6. so even in upper tribunal, it wont be easy to overturn the decision as you were not given right to be heard.

simply write a letter to the home office and also to the HOPPO that you are necessary party to the case, the grounds of refusal were same so you should be awarded the visa after case is withdrawn for reconsideration.

so far so, 3 of my clients got a fresh refusal after the ho withdrew the decision for reconsideration or if judge allowed to limited extent and remitted the case.

i agree that the old policy is no more valid after 31 january even for the old cases. but an argument is that whether the applicant was given chance to explain himself or meet the new requirements or not. if not; doctrine of evidential flexibility will help
