First trick should be deferring the hearing date. I think normally court of appeal takes longer than upper tribunal to hear the case, nevertheless u should be prepared to be called in next 3 months. So defer it let's say by causing a minor injury.

Let me give u a clear idea about long residency: 1) during the appeal u touched 10 years, long residency is intact 2) you lost appeal or got refused and within 28 days you applied for another visa and got approved, long residency is intact 3) made a judicial review claim after the refusal or appeal...

U have the appeal right. So don't waste your time and lodge the appeal by a solicitor coz u don't have any knowledge about appealing

If u applied on time which I can see u did then there must be appeal right whether they gave u that or not. Whether the case worker included any appeal form or not that doesn't matter. Check the refusal letter whether it says u can appeal or not.

As per my understanding those who want to apply from PSW to tier1 must form a company or be registered with inland revenue by tonight( 10 july 2014). secondly tier 4 students can apply only through seed funding and government grant.

Varying the application

Please gurus answer my query. Is it possible to vary an application to another category, if the application is made out of time but no more than 28 days before home office gives a decision?

same happened in my case. dont worry yr appeal is withdrawn. its because the bundle is prepared by case working unit not by presenting officer. so by the time u got the bundle from the case working unit appeal was withdrawn. now home office will make a new decision on your case.
