They shouldnt as you may well fall under the transitional provisions.

Presumably you mean the RC was issued in Jan 2015 (rather than 2014?). So where the RC was issued prior to 25 Nov 2016, the requirement for CSI for the non-EEA spouse where the British sponsor is not working applies only for the period since 25 Nov 2016. It is likely that an EHIC will be valid in place of CSI - but do check.

Also, CSI or equivalent will be needed if the EU sponsor is not working. So even if the American spouse is working and paying a lot of money in taxes, she will still need CSI for as long as the EU sponsor is not in employment.

Yes indeed, SS came about through a judgment in 1992 or thereabouts. However, there is nothing I've seen from the EU which supports how UK applies EEA regs - not in the Directive nor in case law. UK in the guidance to the current form does specify they have incorporated the O&B judgment - however do...

1) length of residence in other member state has not been specified - sometimes 6m (or even 3m) is enough, sometimes even 12m isnt. 2) did your wife have insurance to cover the period since Nov 2016 (when the changes came into force) when you were not employed ? Unsure even with CSI whether as a car...
