Rarely do they act retrospectively though. Yes they did, when the con-lib govt changed the criteria for eligibility for EEA-PR back in 2014 retroactively. I was eligible according to the old criteria but not the new ones. And just one more word: Windrush! Any government can change immigration rules...

I am confident that a settled status, that was legally granted, will not be canceled. It's an application, even though that the HO calls it ''registration''. "Appendix EU" was added to UK domestic immigration regulations by statutory instrument - the government said whatever happens they'll go ahead anyway, deal or no deal. UK law can be amended or over-turned by any elected government. Rarely do they act retrospectively though. It will depend very much on the form of brexit we have. If we get a soft Brexit where UK retains access to the single market then free movement continues and applications will have to assessed on the basis of exercising a treaty rights as opposed to just residence under the EU settlement scheme. Interesting point so if Brexit is cancelled, the Settled status (ILR) is not worth the paper its written on. It might be, but its obvious that except physically lost,it can only be invalid after 2years absence which we can not ascertain now.But reconsideration won't be a bad idea. Less we forget that DCPR was issued in june 2015. I think invalid after 2 years is just a guideline for years of being absent ...

You are her direct family member not extended. No, you cant apply with her. You need to hit your own 5 years to qualify. May I ask isn’t it 5 years from the date of marriage? Not just marriage, everything (marriage, EU national exercising treaty right and them been in the UK) should hit 5 year.

What nationality is the daughter? if British or any other EU national excluding Irish, is she exercising her treaty right in Ireland? if yes then she can take her husband and kids to Ireland as an EU national.
