We and the lawyer have reached agreement to submit what we have, paid the surcharge and did the bio-metric printing.
the lawyer will write a letter stating the reasons behind the non inclusion of the passport (for the second time). I hope it somes out positive in our favor this time.

If you have money, you can try through a PhD (although still under Tier 4), with that you will be given a four years visa.

Finally my visa was approved after approximately 3 weeks with 4 years and 4 months on it.

Finally, I paid the money in full and applied for my visa with a letter of representation from my lawyer, receipt of payment, and other documents.
I am now waiting for their response and hopefully it will come in my favour.

I have not heard anything from them till now, I called and the lady I spoke to sounds comfused but requested that they will call me later.
